Facts

The Antecedents: Between 9:00 and 9:30 in the evening of July 18, 1952, three individuals entered a store in Sampaloc, Manila. Two went to the counter, while the third went to an alley where the store owner, Vicente Go, was standing. The individuals at the counter, armed with a .45 caliber pistol, demanded money from the store attendants, Carlos Go and Amparo Go. One of the robbers took the money from the drawer, amounting to approximately P110. Simultaneously, the person in the alley pushed and shot Vicente Go, who sustained a fatal gunshot wound to the back. The three robbers then fled in a waiting taxi. Procedural History: The police identified the taxi driver as Amado Mamucod, who admitted to driving the taxi and identifying his passengers. Based on this information, the police investigated Agapito Lingad, Leocadio Carreon, Conrado Graham, and Amado Mamucod, securing confessions from them. The Fiscal filed an information for robbery with homicide against them and Estanislao Real, who remained at large. The trial court found all the accused guilty of robbery with homicide and sentenced them to reclusion perpetua, with civil indemnity and costs. The store attendants identified Leocadio Carreon as one of the robbers at the counter and Conrado Graham as the one who took the money. They identified Agapito Lingad as the one who shot Vicente Go. The Petition: The accused appealed their conviction, denying participation and alleging alibi, claiming their confessions were coerced.
