Facts

The Antecedents: Plaintiff Leon Climaco filed an action for damages against defendants Carlos Siy Uy and Manuel Co. Climaco alleged that the defendants maliciously charged him with estafa, conspired to provide false information to mislead the City Fiscal into filing a criminal case without giving him an opportunity to be heard, and arranged for his arrest without opportunity to post bail. These actions allegedly caused Climaco to incur expenses for travel to Manila and damaged his business credit, reputation, and caused him suffering, anguish, and humiliation, for which he sought P19,000.00 in damages. Procedural History: Defendants moved to dismiss the complaint, arguing it stated no cause of action and that the court had not acquired jurisdiction over Carlos Siy Uy, who died before service of summons. While this motion was pending, Climaco sought to amend his complaint to substitute the heirs or executor of Carlos Siy Uy. The lower court initially granted this motion but later reconsidered and issued an order dismissing the action. The Petition: Plaintiff Leon Climaco appealed the order of dismissal.

This is in accordance with Section 21, Rule 3 of the Rules of Court. Furthermore, the action could not be maintained against the executor or administrator under Section 1, Rule 87 of the Rules of Court, as the damages sought did not spring from any injury caused to the plaintiff's person or property, but rather from malicious prosecution. The Court found no error in the denial of the motion for leave to amend the complaint to substitute the heirs of the deceased defendant in this regard. On the dismissal of the action against the surviving defendant Manuel Co: The Court found the order dismissing the case against Manuel Co to be erroneous. The complaint clearly stated a cause of action against Manuel Co, who was a surviving defendant. The death of Carlos Siy Uy did not extinguish the cause of action against Manuel Co, as they were sued as co-defendants. Therefore, the action should have proceeded against Manuel Co.

Main Doctrine

An action for recovery of damages, being a personal action, does not survive the death of the defendant, unless it falls under the exceptions provided in Section 1, Rule 87 of the Rules of Court, which require recovery of real or personal property, or an interest therein, or enforcement of a lien, or damages for injury to person or property.
