Facts

The Antecedents: The victim, Agapito Montaner, Jr., entered a restaurant owned by appellant Alfonso Esma. While inside, appellant Lucilo Esma placed his arm over the victim's shoulder. Subsequently, appellant Santos Ramos stabbed the victim from behind. Appellant Pedro Alemania then struck the victim with fist blows to the face, and appellant Alfonso Esma pushed the victim outside the restaurant, causing him to fall. The victim died fifteen minutes after arrival at the hospital due to hemorrhage resulting from the stab wound. Procedural History: The accused were charged with and convicted of Murder by the Court of First Instance of Surigao. The court found Santos Ramos as the principal and Lucilo Esma, Pedro Alemania, and Alfonso Esma as accomplices. The accused appealed the decision. The Appeal: The defendants-appellants contended that the prosecution's evidence was insufficient to support the findings and the judgment of conviction. They also argued that Santos Ramos should have been convicted only of homicide, not murder.
