Facts

The Antecedents: On May 31, 1907, at approximately 8:00 PM, a group of individuals armed with revolvers and bolos invaded the municipality of San Juan de Guimba, Province of Nueva Ecija. They forcibly entered the municipal treasury and stole P4,779.13 in cash and other property valued at P130. Appellants Nicolas Gutierrez and Leopoldo Lopez were identified by witnesses as participants in the robbery. Procedural History: The defendants were charged with robo en cuadrilla in the Court of First Instance of Tarlac. On October 28, 1907, they were found guilty. Nicolas Gutierrez was sentenced to 12 years and 1 day of cadena temporal, and Leopoldo Lopez and Olimpio Pineda were sentenced to nine years of presidio mayor. All were ordered to return the stolen money or indemnify the municipality for P4,739.13, with deductions for P40 already returned. They were also ordered to pay costs. The Appeal: The defendants appealed their conviction and sentence to the Supreme Court. Olimpio Pineda later withdrew his appeal. The Supreme Court reviewed the evidence presented by both the prosecution and the defense.

Ratio Decidendi

On the Issue of Guilt: The evidence presented, including the recognition of the appellants Nicolas Gutierrez and Leopoldo Lopez by several witnesses as participants in the robbery, clearly established their guilt for the crime of robo en cuadrilla. The court found no doubt regarding their participation in the invasion of the municipal treasury and the taking of the funds. On the Issue of Penalty for Nicolas Gutierrez: The Court found that the penalty imposed on Nicolas Gutierrez by the lower court, twelve years and one day of cadena temporal, was erroneous. According to Article 504 of the Penal Code, when robbery is committed by a gang, the maximum degree of the penalty prescribed by subdivision 5 of Article 503 shall be imposed, which ranges from six years ten months and one day to ten years. The presence of the aggravating circumstance of nocturnity warranted the imposition of the maximum of the maximum penalty, which is ten years. Therefore, the sentence of twelve years and one day was excessive and reversed. On the Issue of Penalty for Leopoldo Lopez: The Court modified the judgment concerning Leopoldo Lopez. While the lower court imposed nine years of presidio mayor, the Court determined that, consistent with the penalty for Nicolas Gutierrez and considering the aggravating circumstance of nocturnity, Lopez should also receive the maximum of the maximum penalty. Thus, he was sentenced to ten years of presidio mayor with the corresponding accessories.

Main Doctrine

When robbery is committed by a gang, the maximum degree of the penalty prescribed for robbery shall be imposed.
