Facts

The Antecedents: On July 27, 1965, a group of individuals, including Jesus Tobias, were waiting for a bus. Policemen, including Guillermo Tabion and Enrique Fagel, approached the group. Luciano Tabuloc engaged Susante Tobias, a councilor, and lured him away. Sensing danger, Susante Tobias and his companions sought refuge inside a drugstore. The policemen then fired into the drugstore. Guillermo Tabion entered the drugstore and fired indiscriminately, hitting Jesus Tobias, who later died. Procedural History: Guillermo Tabion, Enrique Fagel, Luciano Tabuloc, Ignacio Tadena, Maximo Tabuloc, and John Doe were charged with Murder with Multiple Attempted Murder. Maximo Tabuloc and John Doe remained at large. Ignacio Tadena was discharged as a state witness. Guillermo Tabion and Luciano Tabuloc died during trial. Enrique Fagel was the sole defendant tried and convicted by the Court of First Instance of Ilocos Sur, which imposed the death penalty for murder and prison terms for attempted murder, with aggravating circumstances and no mitigating circumstances. The Petition: The case was a mandatory review of the death sentence imposed on Enrique Fagel. The accused appealed his conviction.

Ruling

Due to the lack of the required number of votes for the death penalty, Enrique Fagel was sentenced to suffer the penalty of reclusion perpetua for the killing of Jesus Tobias. The conviction for attempted murder and the civil indemnities were also affirmed.

On the credibility of the alibi: The defense of alibi presented by Enrique Fagel was found to be unmeritorious and could not prevail over the positive testimonies of witnesses who identified him as one of the policemen involved in the shooting incident. Pat. Florentino Tabarnilia, Ignacio Tadena (state witness), Susante Tobias, and Deogracias Tobias all identified Enrique Fagel as participating in the shooting. Furthermore, Fagel's own sworn statement contradicted his alibi, admitting his presence during the incident. On the existence of conspiracy: The contention that there was an absence of conspiracy between Enrique Fagel and Guillermo Tabion was without merit. The Court found that Fagel's direct and active participation in shooting at the persons inside the drugstore clearly demonstrated conspiracy. Therefore, he was considered as guilty as the actual assailant in the commission of the crime. On the presence of evident premeditation: The Court found evident premeditation to be present. A month prior to the incident, Susante Tobias had filed an administrative case against Fagel, Tabion, and Tabuloc for maltreatment. This led the policemen to harbor ill-feelings against Susante Tobias. The incident where Guillermo Tabion stabbed Martin Tela, a relative of Susante Tobias, and expressed his grudge against Susante Tobias, further evidenced the premeditated nature of the crime. The subsequent actions of the policemen on the night of the incident, including their armed approach and strategic positioning, supported the finding of evident premeditation. On the aggravating circumstances: The trial court did not err in finding that the aggravating circumstances were present. Treachery was established because Jesus Tobias was unarmed, unsuspecting, and defenseless when shot while hiding. The circumstance of taking advantage of public position was also considered, as Fagel, a policeman, used his authorized firearm. Additionally, the offense was committed by a band, as there were more than three attackers armed with high-powered guns firing in concert. On the guilt of the accused: Based on the evidence presented, the Court found Enrique Fagel guilty beyond reasonable doubt of murder for the killing of Jesus Tobias and of six counts of attempted murder. The aggravating circumstances of evident premeditation, treachery, taking advantage of public position, and commission by a band qualified the crime and were properly considered by the lower court.
