Facts

The Antecedents: A criminal complaint was filed by Abundio P. Garrido against Director Serafin D. Quiason and Manuel P. Portugal for violation of Section 23 of the Civil Service Law and Article 171 of the Revised Penal Code. The Solicitor General authorized Solicitor Eulogio Raquel-Santos to appear as counsel for Director Quiason in the preliminary investigation. Procedural History: During the preliminary investigation, counsel for the complainant objected to the appearance of the Solicitor General's representative, arguing that the Solicitor General is not authorized to represent a public official accused in his private capacity. The objection was overruled. The matter was elevated to the City Fiscal, who, based on the records, concurred with the opinion that the Solicitor General is authorized to appear in such investigations. Subsequently, respondent Judge Francisco Geronimo issued a preliminary injunction restraining the Solicitor General or his assistants from appearing in the preliminary investigation and the City Fiscal from allowing such appearance. On the authority of the Solicitor General to appear in preliminary investigations: The Court reiterated its ruling in Anti-Graft League of the Philippines v. Ortega that the Solicitor General is authorized to represent government officials in preliminary investigations when the offense imputed to them arose from the exercise of their official functions. This authority is explicitly granted by Section 1661 of the Revised Administrative Code, which states that the Solicitor General, as the principal law officer, shall have authority to act for and represent the Government of the Philippine Islands, its officers, and agents in any official investigation, proceeding, or matter requiring the services of a lawyer. The Court emphasized that this statutory authority is ample. Furthermore, the Court noted that this is a matter of executive authority, and subjecting officials to suits, even ill-founded ones, could delay the implementation of statutes and decrees. However, the Court clarified that this competence of the Solicitor General to appear ceases once a complaint results in the filing of an information, at which point the respondent official must secure his own counsel. Since the stage of filing an information had not been reached in this case, the Solicitor General's appearance was fully warranted by law. On the validity of the preliminary injunction: Given that the Solicitor General's appearance was legally authorized, the preliminary injunction issued by respondent Judge Geronimo, which restrained such appearance, was an act tainted with grave abuse of discretion and was therefore null and void. The Court found no difficulty in reaching this conclusion, relying on its recent decision in Anti-Graft League of the Philippines v. Ortega. The injunction improperly curtailed the statutory authority of the Solicitor General to represent public officers in official matters.
