Adm. Matter No. P-1722 · 1982-08-30 · J. MELENCIO-HERRERA, J.: · Primary: Ethics; Secondary: Criminal
REITERATION

Facts

The Antecedents: Complainant Benigno Caballero charged respondent Deputy Sheriff Walter Villanueva with gross misconduct. Caballero alleged that Villanueva convinced him to buy a parcel of land at a public auction scheduled for November 24, 1976. The auction was repeatedly postponed, and Villanueva demanded and received P2,000.00 as advance payment on December 24, 1976, and an additional P500.00 on January 14, 1977, without issuing receipts. Caballero later discovered from the mortgagee bank that the mortgagor had settled the account and no auction sale would be held. Caballero filed a criminal case for estafa against Villanueva. Procedural History: The letter-complaint was referred to the Executive Judge of the Court of First Instance of Zamboanga del Norte for comment. Villanueva denied the charges, claiming the money was a loan from Melania Aguilar and Jose Aguilar, not from Caballero. The case was referred to the Executive Judge for investigation, report, and recommendation. The investigation was delayed due to postponements, mostly requested by the respondent. During the investigation, Caballero testified that Villanueva took P500.00 as a down payment and P2,000.00 for the bid, which Caballero borrowed from his aunt, Melania Aguilar. Melania Aguilar testified that the P2,000.00 was for the land purchase, not a loan to Villanueva. Respondent and his counsel did not appear on February 27, 1981, and on March 23, 1981, respondent filed a Manifestation stating he had paid complainant the total amount of P2,500.00 and was submitting the case. The Petition: The administrative case was filed against Deputy Sheriff Walter Villanueva for gross misconduct in office.

Ratio Decidendi

On the issue of gross misconduct, dishonesty, and conduct prejudicial to the best interest of the service: The Court found respondent Deputy Sheriff Walter Villanueva guilty of these charges. The complainant alleged that the respondent convinced him to purchase a parcel of land at a public auction, repeatedly postponed the sale, and collected P2,500.00 in advance payments without issuing receipts. The complainant discovered that the land was no longer subject to auction as the mortgagor had settled the account. The respondent denied the charges, claiming the amounts were loans. However, the investigation revealed that the respondent paid back the P2,500.00 to the complainant after the administrative case was filed. This repayment was considered a tacit admission of the complainant's charges. The Executive Judge noted the respondent's delaying tactics during the investigation. The Court agreed with the Deputy Court Administrator that such dishonesty and untrustworthiness cannot be tolerated in public service. The respondent's actions demonstrated a clear breach of the trust reposed in him as a public officer, specifically a deputy sheriff responsible for public auctions. His conduct was found to be prejudicial to the best interests of the service, warranting dismissal. The Court emphasized that the fact that the respondent paid back the complainant, albeit after the filing of the case, served as an admission of the truthfulness of the allegations against him. This act of dishonesty and misconduct directly impacts the integrity of the judicial system and public confidence in its officials.

Main Doctrine

A public officer found guilty of dishonesty and serious misconduct prejudicial to the best interests of the service shall be dismissed from office, with forfeiture of retirement privileges and prejudice to re-employment.
