The Antecedents: In the evening of August 3, 1972, Sabeniano Lobetania, along with Teonito Cordita and Sebastian, offered to buy a pig from spouses Santos and Nelia Cabutaje. At approximately 4:00 AM on August 4, Santos Cabutaje was found bleeding from a stab wound in the chest and subsequently died. Lobetania and his companions demanded money from Nelia, who gave them P3,000 out of fear for her life and her son's. They returned P80 before leaving. Procedural History: Nelia reported the incident to the barrio captain, who informed the police. Nelia and her son, Wencefredo, executed sworn statements. An amended complaint for robbery with homicide was filed against Cordita, Rudy Sumuok, and Sebastian Doe. Lobetania was arrested over two years later in January 1975. In preliminary examinations, Nelia and Wencefredo identified Lobetania as one of the malefactors and the one using the alias Rudy Sumuok. Lobetania waived the second stage of the preliminary investigation. He was again identified by Nelia and Wencefredo at the Constabulary headquarters. The chief of police testified that Lobetania remained silent when questioned about the incident. The Court of First Instance of Agusan del Sur convicted Lobetania of robbery with homicide, sentencing him to reclusion perpetua and ordering him to pay indemnity. The Petition: Sabeniano Lobetania appealed the decision, contending that the lower court erred in giving credence to the testimonies of Nelia and Wencefredo and in convicting him of robbery with homicide.
