People v. Saliente

G.R. No. L-58183 · 1983-02-14 · J. AQUINO, J.: · Primary: Criminal; Secondary: Remedial
REITERATION

Facts

The Antecedents: Leopoldo Saliente appealed his conviction for robbery with homicide and lesiones graves, sentencing him to death and ordering indemnity. Saliente, an illiterate farmer, admitted killing Gregorio Real but claimed self-defense. Real sustained twelve stab wounds, while Saliente sustained thirteen incised wounds. Saliente testified that he went to his sweetheart Norma Real's house, where her father, Gregorio Real, who disliked Saliente, became enraged, struck Saliente with a bolo, and continued to assault him even when his wife asked him to desist. Saliente then drew his knife and stabbed Real. Saliente left and sought medical attention, being hospitalized for over two weeks. The prosecution alleged that Saliente, with several armed companions, went to Real's house, entered through a window, assaulted Real, ransacked the house, and took P500.00. Procedural History: The Court of First Instance of Leyte convicted Leopoldo Saliente of robbery with homicide and lesiones graves. The Petition: Saliente contended that the trial court erred in giving credence to the testimonies of Norma Real and Donata Hernit, finding the prosecution's evidence improbable and contradictory, and in not sustaining his plea of self-defense.

Issue(s)

Whether the guilt of the accused-appellant for robbery with homicide and lesiones graves was proven beyond reasonable doubt. Whether the accused-appellant acted in self-defense.

Ruling

The Court reversed and set aside the trial court's judgment of conviction, absolving Leopoldo Saliente of the crime charged and ordering his immediate release unless detained for another offense.

Ratio Decidendi

On the issue of guilt beyond reasonable doubt: The Court found that the prosecution's evidence was unreliable and contained significant discrepancies and improbabilities. The testimonies of Donata Hernit and Norma Real were noted to have been taken belatedly, and Norma admitted not knowing the perpetrators of the alleged robbery. Furthermore, Donata Hernit's statement in a clarificatory affidavit contradicted her earlier testimony regarding one of the accused. The trial court itself dismissed the case against Romulo Metila and acquitted Benedicto Saliente, indicating doubts about the prosecution's evidence. The Court also noted that Saliente claimed Norma and Donata charged him with robbery with homicide because he did not pay P3,000.00 for Gregorio Real's death. The alleged taking of P500.00 cash was not established with certainty. The Solicitor General, after a painstaking analysis, recommended acquittal due to lack of proof beyond reasonable doubt. On the issue of self-defense: The Court concluded that Gregorio Real was the aggressor and that Saliente acted in self-defense, rendering the killing justified. The evidence presented by the prosecution did not overcome the presumption of innocence afforded to the accused-appellant.

Main Doctrine

The Court reversed the conviction for robbery with homicide and lesiones graves, holding that the accused acted in self-defense, and the prosecution failed to prove guilt beyond reasonable doubt due to inconsistencies and improbabilities in witness testimonies.
