REITERATION

Facts

The Antecedents: Spouses Armin Golondrina and Oliva Salanguste arrived in barrio Boksol to collect debts. While going up the house of Congayao, Armin Golondrina was accosted and stabbed by Edrin Plandez. As Armin fell, Fernando Plandez stabbed him, Pablo Plandez choked and slashed him, and Emiliano Plandez struck him. Armin died of profuse hemorrhage. Procedural History: The Court of First Instance of Samar convicted Emiliano, Fernando, and Pablo Plandez of murder. Fernando was sentenced to reclusion perpetua, while Emiliano and Pablo were sentenced to death. They were also ordered to indemnify the heirs of the deceased. The Petition: The accused-appellants appealed, claiming errors in sustaining the prosecution's theory, rejecting self-defense and alibi, imposing severe penalties, and failing to prove guilt beyond reasonable doubt.

Issue(s)

Whether the trial court erred in sustaining the prosecution's theory despite alleged flaws in witness testimonies. Whether the trial court erred in rejecting the claim of self-defense for Fernando Plandez and alibi for Emiliano and Pablo Plandez. Whether the trial court erred in imposing the penalties of reclusion perpetua and death. Whether the guilt of the accused-appellants was proven beyond reasonable doubt.

Ruling

The appealed decision is affirmed, with the modification that the penalty imposed upon Pablo Plandez is reduced to reclusion perpetua, and the indemnity to the heirs of the deceased Armin Golondrina is increased to P30,000.00.

Ratio Decidendi

On the alleged flaws in witness testimonies and sustaining the prosecution's theory: The Court found no satisfactory showing that any material error was committed by the trial court in appreciating the evidence. The prosecution witness Oliva Salanguste positively identified the appellants as the assailants. The Court gave great weight to the trial court's observation of the witnesses' demeanor and attitude, which is unparalleled in assessing credibility. The prosecution's evidence was found to be sufficient to establish guilt beyond reasonable doubt. On the rejection of self-defense and alibi: The defense of self-defense presented by Fernando Plandez was deemed unnatural and unbelievable by the trial court, particularly his claim of parrying a bolo blow with his own bolo, causing the victim to drop his weapon, and then grappling without sustaining any injury. The Court found this narrative "repugnant to the ordinary" and "a miracle in itself." Furthermore, the bolo used by the deceased was not presented, casting doubt on the self-defense claim. For Emiliano and Pablo Plandez, their alibi was negated by documentary evidence presented by the prosecution, which contradicted their claim of going to the bank to collect a loan. The Court reiterated the rule that alibi, being a weak defense, cannot prevail over positive testimonies of prosecution witnesses. On the imposition of penalties: The trial court correctly imposed the death penalty on Emiliano and Pablo Plandez and reclusion perpetua on Fernando Plandez based on their conviction for murder. However, the Court modified the penalty for Pablo Plandez to reclusion perpetua due to lack of necessary votes and considering his detention since 1969. On whether guilt was proven beyond reasonable doubt: The Court found that the collective actions of the accused-appellants demonstrated a conspiracy to kill the victim. Edrin Plandez initiated the attack, followed by Fernando, Pablo, and Emiliano, each inflicting injuries. Their coordinated actions and community of design to kill Armin Golondrina were evident. The Court held that conspiracy can be inferred from the acts of the accused themselves, pointing to a joint purpose and design. Therefore, their guilt was proven beyond reasonable doubt.

Main Doctrine

Conspiracy can be inferred and proven by the acts of the accused themselves when said acts point to a joint purpose and design, concerted action and community of interests, and such unity of purpose and concert of action serve to establish the existence of the conspiracy and the criminal liability as principals of the conspirators.
