G.R. No. L-43923 · 1984-09-12 · J. ABAD SANTOS, J.: · Primary: Criminal; Secondary: Remedial
REITERATION

Facts

The Antecedents: Accused Martin Maguddayao, Faustino Liquigan, and Laureano Maguddayao were charged with the murder of Cipriano Baliwag, Sr. The information alleged that the accused, armed with a bolo, knife, and gun, conspired to kill the victim with evident premeditation and treachery, inflicting several fatal wounds. Procedural History: The accused were found guilty of murder by the Court of First Instance of Cagayan and sentenced to an indeterminate penalty of 14 years, 8 months, and 1 day to 17 years, 4 months of reclusion temporal, with civil indemnity and costs. All three appealed to the Court of Appeals. Faustino Liquigan was granted bail pending appeal. Martin Maguddayao was allowed to withdraw his appeal. The Court of Appeals certified the case to the Supreme Court due to the recommendation that the penalty should be reclusion perpetua. Laureano Maguddayao later filed a motion to withdraw his appeal, which the Supreme Court denied. The Appeal: The case proceeded before the Supreme Court concerning Faustino Liquigan and Laureano Maguddayao. The Court of Appeals had affirmed the trial court's finding of murder and recommended the imposition of reclusion perpetua. The appellants, Faustino Liquigan and Laureano Maguddayao, interposed the defense of alibi.

Issue(s)

Whether the guilt of the accused Faustino Liquigan and Laureano Maguddayao for the crime of murder was proven beyond reasonable doubt. Whether the alibi interposed by the appellants is sufficient to exculpate them from the crime charged.

Ruling

The judgment of the trial court finding the appellants guilty of murder is affirmed, but the sentence is modified to suffer the penalty of reclusion perpetua. The appellants are ordered to jointly and severally indemnify the heirs of the deceased in the sum of P30,000.00, with costs against them.

Ratio Decidendi

On Issue 1: The Court affirmed the finding of guilt for murder beyond reasonable doubt. The prosecution presented eyewitnesses, Avelino Baliwag and Cipriano Baliwag, Jr., who positively identified the appellants as the perpetrators of the crime. Their testimonies detailed how the appellants, in conspiracy, attacked and inflicted multiple stab wounds on the victim, Cipriano Baliwag, Sr., and how Laureano Maguddayao also chased and injured Cipriano Baliwag, Jr. The necropsy report corroborated the testimonies by detailing ten stab wounds on the deceased, consistent with the manner of attack described by the witnesses. The Court found the evidence of the prosecution to be strong and credible, outweighing the defenses presented by the appellants. The Court also noted that the Court of Appeals had affirmed these findings, and the Supreme Court adopted them. On Issue 2: The Court rejected the alibi interposed by both appellants, Laureano Maguddayao and Faustino Liquigan. The Court reiterated the well-established rule that alibi is a weak defense, easily fabricated and requiring strong corroboration. In this case, the alibis were contradicted by the positive identification of the appellants by two principal eyewitnesses. Furthermore, the rebuttal testimony of Juan Liquigan indicated that Laureano Maguddayao was in the area during the period of mourning for the victim. Lucio Camayang's testimony also directly refuted Faustino Liquigan's claim of working on a house construction at the time of the murder, stating the construction occurred much later. Therefore, the alibis were not sufficiently corroborated and were deemed unbelievable in the face of direct evidence.

Main Doctrine

The Court affirmed the conviction for murder based on the strength of eyewitness testimony that positively identified the accused, despite their claims of alibi. The Court reiterated that alibi is a weak defense easily fabricated and will not be given credence when contradicted by clear and convincing evidence. Consequently, the penalty of reclusion perpetua was imposed, along with the award of civil indemnity to the heirs of the deceased.
