Facts

The Antecedents: On April 5, 1981, complainant Lucila Muncal, then less than 16 years old, was on her way home at about 10:00 PM. She was intercepted by accused Anselmo Germino and Eduardo Germino. After the incident, Lucila Muncal went home, changed her clothes, and did not immediately report the incident due to fear of her father and threats from the accused. She eventually reported the incident on May 3, 1981, leading to a medical examination on May 4, 1981. Procedural History: The Regional Trial Court in Cabanatuan City convicted Anselmo Germino of Rape and sentenced him to reclusion perpetua, with indemnity for moral damages and attorney's fees.
