Facts

The Antecedents: Antonio Punsalan and his sons Elias and Perfecto were in a hut near a water hole claimed by Elias. While there, Emiliano Ramos approached and warned them not to take fish from the water hole. Antonio asserted ownership, leading Emiliano to fetch his father, Segundo Ramos, and brother, Luis Ramos. Segundo reiterated the warning, stating he had bought the water hole. Perfecto Punsalan insisted they would proceed. Emiliano Ramos, positioned behind Perfecto, struck him a blow in the back with a bolo (pisao) while Perfecto was seated, unarmed, and defenseless. As Perfecto turned, Emiliano struck him again in the face. Elias Punsalan intervened, disarming Emiliano. While Elias and Emiliano struggled, Luis Ramos struck Elias in the head. Segundo Ramos then attacked Perfecto, who was on the ground, inflicting a mortal wound in the abdomen. Elias, seeing this, struck Segundo in the foot to prevent further harm to his brother. Sabino de Leon attempted to mediate, but Luis Ramos struck Leon in the neck, and Segundo wounded him in the hand. Procedural History: The accused were convicted of murder in the Court of First Instance of Bulacan and sentenced to cadena perpetua. The Petition: The accused appealed their conviction.

On whether Luis Ramos and Segundo Ramos are principals in the crime of murder: The Court affirmed that under the Penal Code, not only those who cooperate in the execution of an act without which it would not have been accomplished are authors, but also those who take direct part in the execution of the act itself. The evidence showed that Luis Ramos and Segundo Ramos took direct part in the acts by which Perfecto Punsalan met his death, thus making them principals. On whether Luis Ramos and Segundo Ramos should be convicted of murder despite not directly participating in the initial treacherous blow: The Court held that even if Luis Ramos and Segundo Ramos did not directly participate in the initial treacherous blow by Emiliano Ramos, they became principals by their subsequent actions. After Emiliano struck Perfecto, Segundo Ramos attacked the fallen Perfecto, inflicting a mortal wound in the abdomen. Simultaneously, Luis Ramos prevented Elias Punsalan from defending his brother. By taking advantage of Emiliano's attack and its results, and by actively participating in the assault on the victim and preventing intervention, Luis and Segundo sanctioned the initial blow and became liable for the same qualifying circumstances, namely alevosia (treachery), as Emiliano. Therefore, they were correctly convicted of murder.

Main Doctrine

All individuals who take direct part in the execution of acts leading to a death, or who cooperate in the execution of the act without which it would not have been accomplished, are considered authors or principals in the crime. Those who take advantage of an attack initiated by another, and inflict further injuries, are also considered principals and may be imputed the same qualifying circumstances present in the initial act.
