Facts

The Antecedents: On January 9, 1910, around 9 a.m., Fernando Agustin was driving a cart pulled by a bull along the Currimao Road towards Paoay. Magdalena Saguyot was riding in the cart, which contained three trunks and a bundle. The road was crowded with people due to the arrival of a steamer. Agustin yelled at his bull, causing it to run at a fast pace. Consequently, an elderly pedestrian, Melecio Navarro, was knocked down by the cart, and one of its wheels passed over him. Despite immediate assistance, Navarro died within an hour. Procedural History: A complaint was filed by the provincial fiscal in the Court of First Instance of Ilocos Norte, charging Fernando Agustin with homicide by reckless negligence. On July 23, 1910, the court found Agustin guilty and sentenced him to one year and one day of prision correccional, with the accessories of Article 61 of the Penal Code, ordered him to pay P1,000 in indemnity to the heirs of the deceased, and to pay the costs.
