People v. Nunag

G.R. No. 54445 · 1989-05-12 · J. PADILLA, J.: · Primary: Criminal; Secondary: Remedial
REITERATION

Facts

The Antecedents: The accused-appellants Mario Nunag, Arnel Mandap, Efren Salangsang, Danilo Carpio, and Diosdado Manalili were charged with rape. The complainant, Lorenza Lopez, a 15-and-a-half-year-old girl, testified that on the second week of May 1978, at around 7:30 PM, she was outside a neighbor's house when Mario Nunag approached her, threatened her with a knife, and forced her into a nearby ricefield. The other accused joined them, and they allegedly took turns having sexual intercourse with her against her will. She lost consciousness after the second accused, Arnel Mandap, finished and regained consciousness while Diosdado Manalili was abusing her. The accused warned her not to report the incident or they would kill her and her family. She did not report immediately due to fear. Later, she discovered she was pregnant and eventually gave birth to premature twins who died shortly after. Procedural History: The Court of First Instance of Pampanga found all accused guilty. Mario Nunag, Arnel Mandap, and Efren Salangsang were sentenced to reclusion perpetua. Danilo Carpio and Diosdado Manalili, being minors (16-18 years old at the time of the offense), received indeterminate penalties. All were ordered to indemnify the victim. The accused appealed. The Petition: The accused-appellants assailed the trial court's decision, claiming the complainant's testimony was concocted and contained irreconcilable contradictions.

Issue(s)

Whether the complainant's testimony is credible despite alleged inconsistencies and delay in reporting. Whether the medical findings regarding the complainant's pregnancy are conclusive given the presence of twins. Whether the accused conspired to commit rape, and if so, the extent of each accused's liability for the acts committed.

Ruling

The Supreme Court affirmed the judgment of the trial court with modifications regarding the number of rapes each accused was found guilty of. Mario Nunag, Arnel Mandap, and Diosdado Manalili were found guilty of three counts of rape each by direct participation. Danilo Carpio and Efren Salangsang were found guilty of three counts of rape each by indispensable cooperation. The penalties were adjusted accordingly, with minors receiving indeterminate sentences for each count. The indemnification was maintained.

Ratio Decidendi

On Issue 1: The Court found the complainant's testimony credible. It reasoned that she had no motive to falsely accuse her neighbors of such a grave crime. Her timidity and inexperience made it improbable for her to fabricate such a story and undergo the humiliation of a public trial. The delay in reporting was satisfactorily explained by her fear of reprisal from the accused, who had threatened her and her family. The Court reiterated that the testimony of a rape victim is credible when she has no motive to testify falsely against the accused. On Issue 2: The Court found the contention regarding the medical findings to be without merit. The initial estimations of the complainant's pregnancy by Dr. Teresita Santos and Dr. Ricardo Naguit were based on the assumption that she was carrying only one child. Both doctors testified that their findings would have been different had they known she was carrying twins. The premature birth of twins, which occurred after the alleged rape, supported the complainant's testimony and explained the discrepancy in the medical estimations of her gestational age. On Issue 3: The Court modified the finding of guilt regarding the number of rapes committed by each accused. While conspiracy was established, the complainant's testimony indicated she lost consciousness after the second accused, Arnel Mandap, had intercourse with her and regained consciousness only when the fifth accused, Diosdado Manalili, was abusing her. Therefore, she could not definitively state that Efren Salangsang and Danilo Carpio had personally abused her, only that they were present and part of the group. Consequently, Mario Nunag, Arnel Mandap, and Diosdado Manalili were found guilty of rape by direct participation, while Danilo Carpio and Efren Salangsang were found guilty of rape by indispensable cooperation for their role in the conspiracy, each being held liable for three distinct crimes of rape.

Main Doctrine

The credibility of a rape victim is upheld when she has no motive to testify falsely against the accused, and her fear of reprisal, which explains the delay in reporting the incident, is a valid consideration. The inconsistencies in the medical findings regarding pregnancy duration are resolved by the fact that the victim was carrying twins, not a single child, which affects the estimation of gestational age.
