The Antecedents: On August 3, 1985, in Barangay Tibiao, Altavas, Aklan, Romulo Sonio was shot while tapping tuba on top of a coconut tree. His wife, Mercedita Sonio, witnessed the shooting and identified Federico Toribio as the assailant, who was armed with a shotgun locally known as "pugakhang." Mercedita testified that she saw Federico aiming the shotgun at Romulo from about two arm's length, and after the shot, Romulo fell from the tree. The autopsy report indicated multiple gunshot wounds on the victim's chest and abdomen, which caused his death. An information for murder was filed against Federico Toribio and his co-accused Narding Toribio, Reyson Toribio, and Freddie Toribio.
