Facts

On treachery: The Court found the qualifying circumstance of treachery to be present. The attack on the victim was executed in such a manner as to preclude any defense that he might have made, ensuring the commission of the crime without risk to the assailants from any defensive or retaliatory act on the part of the victim. On indemnity: The Court found no reason to disturb the findings of the Regional Trial Court regarding the guilt of the accused. However, in conformity with present doctrine, the indemnity awarded by the trial court was increased from P30,000.00 to P50,000.00.
