Simultaneously, Juanito Villanueva and Jimmy Villanueva sustained injuries. Two criminal cases for murder and frustrated murder were filed against Rudy Villanueva, Juanito "Ben" Villanueva, Jimmy Villanueva, Vino Villanueva, Meliton Villanueva, Maning Cariño, and Nelson Villanueva. Conversely, two cases for attempted homicide were filed against Marcelino Paloyo for injuries sustained by Juanito Villanueva and Jimmy Villanueva. Procedural History: The four cases were jointly tried. The Regional Trial Court (RTC) convicted the accused in the murder and frustrated murder cases and acquitted them in the attempted homicide cases. The accused appealed to the Court of Appeals (CA). The CA affirmed the conviction for murder and frustrated murder, sentencing the accused to reclusion perpetua and an indeterminate penalty, respectively. The CA ordered the records elevated to the Supreme Court for review. Similarly, Marcelino Paloyo was held by Vino and Nelson Villanueva while Rudy Villanueva stabbed him. The Court reiterated that conspiracy exists when two or more persons come to an agreement concerning the commission of a felony and decide to commit it, requiring a concurrence of wills or unity of action or purpose. Rudy Villanueva was positively identified by prosecution witnesses as the one who stabbed the victims, and his claimed alibi did not demonstrate physical impossibility of his presence at the scene, as he was only approximately 300-500 meters away. On the appreciation of treachery: The Court found that treachery was properly appreciated against the accused-appellants. The victims were stabbed without warning, and the attack was so sudden that they were not given a chance to defend themselves, as evidenced by the severity and multiplicity of the wounds inflicted upon them. Treachery is present when the offender commits any of the crimes against persons, employing means, methods, or forms in the execution thereof which tend directly and specially to ensure its execution, without risk to the offender arising from the defense which the offended party might make. The manner of the attack, characterized by holding the victims while being stabbed, clearly demonstrates the presence of treachery.
