Facts

The Antecedents: Estelita Bentulan, a married woman separated from her husband, was the owner of a sari-sari store. On December 24, 1989, accused-appellant Roberto Jaca was a customer at her store. Later that night, Estelita attended midnight mass and returned home alone. At around 3:00 AM on December 25, 1989, Jaca entered Estelita's house, covered her mouth with his hand, and threatened her with a knife. Estelita recognized his voice as that of Jaca, a former suitor and regular customer. Jaca proceeded to have carnal knowledge with Estelita against her will, despite her struggle. He tore her panty during the struggle. After satisfying his lust, Jaca identified himself. Estelita escaped and reported the incident to the Bantay Bayan and then to the barangay captain. Procedural History: Estelita Bentulan filed a complaint for Rape against Roberto Jaca y Donaire. The Regional Trial Court of Hinongos, Leyte, found Jaca guilty beyond reasonable doubt of the crime of Rape and sentenced him to suffer reclusion perpetua and to pay P20,000.00 as indemnity. The Petition: Jaca appealed the decision, assigning as error the trial court's finding of guilt beyond reasonable doubt.
