Facts

The Antecedents: Elizabeth Ilagan, a minor, was walking home when she encountered Rodelio Guerrero. Rodelio Guerrero was joined by Rogelio Mercado and Reynaldo Mercado. Rodelio Guerrero then boxed Elizabeth Ilagan multiple times, causing her to become partially unconscious. Rogelio Mercado and Reynaldo Mercado held Elizabeth Ilagan's arms and legs while Rodelio Guerrero removed her clothing and forcibly had carnal knowledge of her. Elizabeth Ilagan lost consciousness during the act and regained it about ten minutes later. She later reported the incident to her father, who had her examined by a doctor. The doctor found lacerations on Elizabeth Ilagan's hymen consistent with penile penetration. Elizabeth Ilagan initially provided a written statement to the police naming Rodelio Matienzo, Gerardo Matienzo, Rogelio Mercado, and Rodelio Guerrero as perpetrators. Her father filed a complaint, and an offer to settle was made by representatives of the appellants. Procedural History: The Regional Trial Court (RTC) found Rodelio Guerrero, Rogelio Mercado, and Reynaldo Mercado guilty beyond reasonable doubt of the crime of Rape, sentencing each to suffer the penalty of reclusion perpetua and to indemnify the victim. The case against Gerardo Matienzo was dismissed due to lack of evidence. The convicted accused appealed the RTC decision. The Petition: The accused-appellants imputed errors to the trial court, primarily questioning the credibility of the victim's testimony, the finding of conspiracy, and the conviction for rape.

Ratio Decidendi

On the alleged inconsistencies in the victim's testimony: The Court found no glaring inconsistencies in the victim's testimony. The victim positively identified the accused-appellants during direct examination. Her partial loss of consciousness after being boxed did not prevent her from perceiving the events, including the sexual organ of the perpetrator. The Court also clarified that the complaint filed by the victim's father, not the victim herself, contained discrepancies regarding the use of a firearm and the number of perpetrators involved in the sexual intercourse, which were explained by the victim's father's role in filing the complaint and the victim's state of shock. The absence of marks of violence on the victim's person does not negate the commission of rape, as force applied to the stomach may not leave marks, and the lack of marks on the breast could be due to a light blow or incidental contact during a struggle. The victim's credibility was upheld as she had no motive to falsely testify against the accused-appellants. On the finding of conspiracy: The Court held that there is no need to prove a previous agreement among the malefactors to commit the crime if their overt acts clearly show they acted in concert in pursuit of their unlawful design. The concerted acts of holding the victim's arms and legs by Reynaldo and Rogelio to enable Rodelio to rape her manifestly demonstrated the existence of conspiracy and a common design to rape her. The Court reiterated the principle that where conspiracy is established, the act of one is the act of all. On the conviction for rape and sentencing: Given the established conspiracy, the Court affirmed the trial court's finding that all the accused committed the crime of rape. The penalty of reclusion perpetua was affirmed as it is the prescribed penalty for rape under Article 335 of the Revised Penal Code. The indemnification of P50,000.00 to the victim was also maintained.
