REITERATION

Facts

The Antecedents: On April 11, 1994, SPO1 Romeo Labra was shot and killed in his compound, and SPO2 Eduardo Mansueto was shot and killed at the Municipal Building of Madridejos, Cebu. PO3 Samson Patalinghug was identified as the perpetrator of both killings. Benito Pasilaban and Ronaldo Gordo were accused as co-conspirators. Procedural History: The Regional Trial Court of Cebu City, Branch 10, found PO3 Samson Patalinghug, Benito Pasilaban, and Ronaldo Gordo guilty of two counts of murder. They were each sentenced to suffer reclusion perpetua and to indemnify the heirs of the victims. Pasilaban and Gordo appealed their conviction. The Petition: Appellants Pasilaban and Gordo argued that the trial court erred in convicting them as co-conspirators due to the absence of clear and convincing proof of their culpability. Patalinghug claimed self-defense.

Issue(s)

Whether PO3 Samson Patalinghug is guilty of murder for the killings of SPO1 Romeo Labra and SPO2 Eduardo Mansueto, considering his claim of self-defense, and whether treachery attended the killings. Whether Benito Pasilaban and Ronaldo Gordo are guilty as co-conspirators in the murders of SPO1 Romeo Labra and SPO2 Eduardo Mansueto.

Ruling

The Supreme Court affirmed the conviction of PO3 Samson Patalinghug for two counts of murder, sentencing him to reclusion perpetua. Benito Pasilaban and Ronaldo Gordo were acquitted and ordered released. The Court ordered Patalinghug alone to indemnify the heirs of the deceased victims.

Ratio Decidendi

On the guilt of PO3 Samson Patalinghug and the claim of self-defense: The Court held that Patalinghug failed to prove self-defense by clear and convincing evidence. Unlawful aggression, an essential element of self-defense, was not established as the victims were unarmed and Patalinghug initiated the attacks. The prosecution's evidence, including the testimonies of eyewitnesses and the medical findings of multiple gunshot wounds on both victims, contradicted Patalinghug's claims. The presence of numerous wounds on the victims indicated a determined effort to kill, negating self-defense. Furthermore, the Court found that treachery attended both killings, as the attacks were sudden, unexpected, and afforded the victims no chance to defend themselves. Patalinghug's claim that Labra was about to draw a firearm was not substantiated, and his account of the encounter with Mansueto was contradicted by Mansueto's daughter, who testified that Patalinghug greeted Mansueto with a smile before firing. The Court reiterated that the trial court's assessment of witness credibility, having observed their demeanor, is entitled to great respect. On the conspiracy of Benito Pasilaban and Ronaldo Gordo: The Court found that the evidence presented did not establish conspiracy beyond reasonable doubt. While Pasilaban and Gordo were with Patalinghug before and after the killings, their mere presence at the scene of the crime, or their use of the motorcycle, was insufficient to prove a common design or unity of purpose with Patalinghug. The defense presented plausible explanations for their presence, such as going to buy cement and giving Patalinghug a ride. There was no evidence showing that Pasilaban and Gordo agreed with Patalinghug to commit the crimes or that they actively participated in their execution. The Court noted that Patalinghug's extrajudicial affidavit, claiming sole responsibility, could not be given credence as it was executed after conviction and while he was detained. However, the lack of evidence of conspiracy against Pasilaban and Gordo led to their acquittal.

Main Doctrine

The elements of self-defense must be proven by clear and convincing evidence. The presence of a large number of wounds on the victim negates self-defense. Conspiracy requires proof of a common design and unity of purpose, and mere presence at the scene of the crime is insufficient.
