Facts

The Antecedents: On November 9, 1991, at around 6:00 PM, several visitors arrived at the house of Pedro and Agustina Cagurungan to invite helpers to a dance party. While the family was having supper, their dogs began barking. Agustina, using a flashlight, observed the surroundings. She then heard a gunshot and saw Zaldy Binarao fall. Subsequently, she heard rapid bursts of gunfire from the kitchen. Intruders, identified by Agustina as appellants Pablo and Juan Panaga, forcibly entered the house, took Pedro Cagurungan outside, and after hearing more gunshots, Agustina found her husband with multiple gunshot wounds. Pedro, before succumbing, identified "Bondying" (Pablo Panaga) and "Uncle Ifan" (Juan Panaga) as his assailants. The bodies of Rolando Balisi, Jeofrey La Madrid, and Zaldy Binarao were found in different locations around the premises. Procedural History: The Regional Trial Court (RTC), Branch 3, of Tuguegarao, Cagayan, found Pablo Panaga and Juan Panaga guilty beyond reasonable doubt of murder in four separate criminal cases (Criminal Cases No. 661, 663, 664, and 665) and sentenced them to reclusion perpetua in each case, along with various civil liabilities, including P50,000.00 for each death, P31,000.00 for actual damages, P4,132,800.00 for loss of earnings in Criminal Case No. 664, moral damages, and attorney's fees. The Petition: The accused-appellants appealed their conviction, insisting on their innocence and alleging errors on the part of the lower court.

On the guilt of the accused-appellants: The Court found the evidence sufficient to establish the guilt of the accused-appellants beyond reasonable doubt. Agustina Cagurungan's testimony, identifying the appellants as the perpetrators, was clear and straightforward. Furthermore, the dying declaration of Pedro Cagurungan, identifying "Bondying" (Pablo Panaga) and "Uncle Ifan" (Juan Panaga) as his shooters, was given under the consciousness of impending death and referred to the cause and circumstances of his injury, thus qualifying it as a dying declaration of high credence. The post-mortem examinations confirmed that the victims died of gunshot wounds. The Court also considered the circumstantial evidence, which, when taken together, sufficiently warranted a finding of guilt. The defense of denial and alibi was unconvailing against the strong positive identification by the victim and the eyewitness. On the awards for actual damages and loss of earnings: The Court found that the awards for P31,000.00 for actual and compensatory damages and P4,132,800.00 for loss of earnings were not properly substantiated by evidence. Actual damages must be proven with reasonable certainty, supported by receipts, and cannot be based on conjecture or guesswork. The alleged monthly income of the victim Pedro Cagurungan as a chainsaw operator and from his farmland were not substantiated by any documentary evidence and appeared speculative. Therefore, these awards were deleted.
