Facts

The Antecedents: Lolita Watanabe entrusted US$1,400.00 and 400,000.00 yen (equivalent to P50,000.00) to Wilma Barrameda for delivery to Lolita's mother, Papiniana Paguinto, in the Philippines. Upon arrival at the Manila International Airport (NAIA), Barrameda informed Papiniana that she had misplaced the money. They searched the baggage, and Barrameda promised to deliver the money the following day. Despite repeated demands, Barrameda failed to deliver the money. Procedural History: The Regional Trial Court (RTC) of Pasay City convicted Wilma Barrameda of estafa under Article 315, par. 1(B) of the Revised Penal Code. The Court of Appeals affirmed the RTC decision. The Supreme Court reviewed the case on petition for review on certiorari. The Petition: Petitioner Barrameda questioned the jurisdiction of the RTC, arguing that no element of the crime occurred within its territorial jurisdiction. She also contended that the prosecution failed to prove her guilt beyond reasonable doubt, assailing the credibility of witnesses and the admissibility of documentary evidence.

On the jurisdiction of the RTC of Pasay City: The Court held that the RTC of Pasay City validly exercised its jurisdiction because one of the essential ingredients of estafa, namely, the demand for the return of the money, occurred within its territorial jurisdiction. Papiniana Paguinto met the accused at the Ninoy Aquino International Airport (NAIA), which is within Pasay City, to collect the money. The Court clarified that the specific word "demand" need not be used; a query as to the whereabouts of the money, as in this case, is tantamount to a demand. Therefore, the RTC had jurisdiction as an essential element of the offense took place within its territory. On the proof of guilt beyond reasonable doubt: The Court affirmed the findings of the trial court and the Court of Appeals regarding the credibility of the prosecution witnesses. The testimony of Lolita Watanabe positively declared that she gave the money to the accused. This was corroborated by the testimonies of Papiniana Paguinto and Ruben Barrameda, detailing the events of the money being entrusted, misplaced, and subsequently demanded. The defense's version, characterized by inconsistencies, was deemed unworthy of belief. Mere denial cannot overcome positive testimonies and documentary evidence. On the admissibility of the letter and telephone receipts: The Court found no error in the admission of the November 15, 1984 letter, as it was properly identified by the sender (Lolita Watanabe) and the recipient (Papiniana Paguinto). The testimony of the intermediary ("Nancy") was not necessary for its identification. Regarding the telephone receipts, while in Japanese, they contained English or numerical entries indicating dates and calls to the Philippines, supporting the fact that telephone conversations regarding the money occurred. Even if these receipts were excluded, the other evidence sufficiently established the accused's failure to deliver the entrusted amount. On the erroneous penalty imposed: The Court noted that the penalty imposed by the trial court was erroneous based on the amount of fraud. For P50,000.00, the applicable penalty under Article 315 of the Revised Penal Code is prision correccional in its maximum period to prision mayor in its minimum period, with an additional year for every P10,000.00 exceeding P22,000.00, up to a maximum of twenty years. The Court modified the indeterminate sentence to two (2) years and four (4) months of prision correccional, as minimum, to ten (10) years of prision mayor, as maximum, consistent with the Indeterminate Sentence Law.
