Facts

The Antecedents: The Supreme Court resolved four (4) unnumbered resolutions from the Sandiganbayan concerning: (a) acquisition of three motor vehicles for Justices' use; (b) appointments, promotions, assignments, suspensions, dismissals, or disciplinary actions on officials and employees; (c) an Amended Memorandum of Understanding (MOU) with PEA regarding a building; and (d) opening and leasing of a canteen, establishing a medical-dental clinic, and adopting employee welfare plans. Procedural History: The Supreme Court referred these matters to its Oversight Committee. A breakfast conference was held with the Sandiganbayan Justices. The Committee directed the SC Motorpool to examine the vehicles, leading to the approval of acquiring three new vehicles. For matters concerning internal affairs, Atty. Adelaida Cabe-Baumann was tasked to study and recommend the delineation of non-judicial powers. Her memorandum proposed the creation of various committees within the Sandiganbayan. The Oversight Committee adopted this memorandum and recommended its adoption by the Sandiganbayan. Regarding the Amended MOU with PEA, the Presiding Justice's apprehensions about the building were deemed unfounded based on various permits and certificates issued, and the fact that defects were minor and remediable. The Associate Justices' memorandum disputed the Presiding Justice's concerns. The Petition: The Supreme Court, through its Resolution, addressed each of the four items referred by the Sandiganbayan.

Ruling

The Supreme Court ordered: 1. In A.M. No. 00-8-04-SB and A.M. No. 00-8-06-SB, the Sandiganbayan is directed to ADOPT AND IMPLEMENT the recommendations contained in the Memorandum of Atty. Adelaida Cabe-Baumann dated 19 February 2000. 2. In A.M. No. 00-8-05-SB, the Sandiganbayan is directed to ACCEPT the newly constructed building, pay its obligation to PEA, and SIGN the Amended Memorandum of Understanding with PEA without further delay. 3. In A.M. No. 00-8-05-SB, the Department of Budget and Management is DIRECTED to RELEASE the Notice of Cash Allocation (NCA) in the amount of P164,985,029.76. 4. A.M. No. 00-8-03-SB is CLOSED AND TERMINATED.

Ratio Decidendi

On the acquisition of three motor vehicles (A.M. No. 00-8-03-SB): The Supreme Court, after referring the matter to its Oversight Committee and receiving a recommendation based on an examination of the vehicles, granted authority to the Sandiganbayan to acquire three new vehicles from its savings. This action was taken after finding the necessity for replacement. Consequently, this particular matter was deemed closed and terminated upon the purchase of the vehicles. On internal affairs and personnel actions (A.M. No. 00-8-04-SB and A.M. The Court emphasized that delaying acceptance and payment was unfair, especially considering the substantial cost of the facility and the fact that Congress had appropriated funds for amortization. On the release of Notice of Cash Allocation (NCA): The Department of Budget and Management was directed to release the requested NCA to cover the amortization due to PEA. This was in response to the Presiding Justice's letter informing the Court of the unpaid amortization and the reason for non-payment, which was the DBM's failure to act on the request for NCA release.
