Facts

Ratio Decidendi

On the issue of jurisdiction: The Court held that the Municipal Trial Court (MTC) correctly denied the motion to dismiss. The case involved title to or possession of real property with an assessed value of less than P20,000.00, as shown in Tax Declaration No. 20-1095-A. This falls within the exclusive original jurisdiction of the MTC, as provided by Section 33 of Batas Pambansa Blg. 129, as amended by Republic Act No. 7691. The fact that Lot 2944-B was sold in an execution sale in Civil Case No. 8058 before the Regional Trial Court (RTC) does not divest the MTC of its jurisdiction over the present action. The Court emphasized that the current case is independent of Civil Case No. 8058, as it concerns Lot 2944-B, whereas Civil Case No. 8058 primarily involved Lot 5758 and Lot 2944-A. The involvement of Lot 2944-B in Civil Case No. 8058 was solely for the execution sale to satisfy monetary damages, and these execution proceedings had already been terminated. The principle of judicial stability applies when the same court that rendered the decision is asked to resolve controversies related to its execution, which is not the situation here as the current action is a separate claim for ownership and possession based on the execution sale. On the issue of forum shopping: The Court found no merit in the petitioners' claim of forum shopping. Forum shopping is the act of instituting two or more actions or proceedings grounded on the same cause of action, or involving the same issues, or seeking the same relief, or involving the same parties, or involving the same facts and circumstances. In this case, the subject matter of Civil Case No. 8058 was Specific Performance and Damages, involving Lots 5758 and 2944-A. The current case, Civil Case No. 735 before the MTC, is for recovery of possession and ownership of Lot 2944-B. While Lot 2944-B was sold in execution to satisfy damages in Civil Case No. 8058, the present action is a distinct claim for ownership and possession of that specific lot, based on the sheriff's sale and the subsequent failure of the petitioners to comply with the conditions of their continued occupancy. Therefore, the issues and the specific subject properties involved are different enough to preclude a finding of forum shopping.
