Ruling

On the conviction for murder and the presence of treachery and evident premeditation: The Court held that the trial court erred in finding treachery. While the attack was sudden, the evidence showed that the victim and accused-appellant engaged in a struggle for several minutes before the fatal blow. This negates the element of treachery, as the victim was not caught completely unaware and had an opportunity to defend himself or retaliate. Furthermore, the heated argument prior to the attack served as a warning to the victim. The Court also found that evident premeditation was not established, as there was no proof of the time the offender determined to commit the crime, an overt act indicating adherence to that determination, and a sufficient lapse of time for reflection. The killing resulted from an argument minutes prior to the attack. On the claim of self-defense: The Court rejected the claim of self-defense. A plea of self-defense shifts the burden of proof to the defense, requiring clear and convincing evidence of unlawful aggression, reasonable necessity of the means employed, and lack of sufficient provocation. The Court noted that the prosecution and defense had stipulated that the accused-appellant stabbed the victim, admitting the criminal act. The accused-appellant's testimony was contradicted by prosecution witnesses who stated the accused-appellant attacked the victim after jumping from the roof. Even a defense witness admitted the accused-appellant jumped from the roof. The defense failed to prove that the victim was the aggressor or that the accused-appellant acted in self-defense. The Court also dismissed the claim of accidental stabbing, citing the nature and depth of the two stab wounds inflicted. On the awarded damages: The Court affirmed the civil indemnity of P50,000.00. However, it found the P30,000.00 awarded as nominal damages to be excessive and reduced it to P15,000.00, considering that hospital and funeral expenses were incurred.
