Facts

The Antecedents: Appellants Ricardo Cachola (RICARDO) and Freddie Mendoza (FREDDIE) were convicted of murder for hacking to death Magno Cabael and were sentenced to suffer the death penalty. The prosecution presented Dolores Cabael who testified that on the evening of February 17, 1995, she and Mariano Cabael witnessed RICARDO and FREDDIE enter the house of Magno Cabael, armed with bolos, and hack Magno. They also heard Buenafe Cabael screaming for help. Dolores saw RICARDO and FREDDIE maul Buenafe and take her away. Upon checking Magno's house, they found him dead. A post-mortem examination revealed multiple hack wounds on Magno, with the cause of death being cardio-respiratory arrest secondary to cerebral hemorrhage due to hack wounds. Buenafe's remains were exhumed later, and the Municipal Health Officer advised consultation with a medico-legal expert regarding the cause of her death. Procedural History: The Regional Trial Court of Aparri, Cagayan, Branch 10, convicted RICARDO and FREDDIE of murder in Criminal Case No. 10-585, appreciating the aggravating circumstances of dwelling and nocturnity, and sentenced them to death. They were acquitted in Criminal Case No. 10-586 for the disappearance and alleged death of Buenafe Cabael due to insufficiency of evidence. The accused appealed the decision. The Petition: Appellants asserted that the trial court erred in admitting the identification of the accused, giving credence to the eyewitness testimonies, ignoring material contradictions, disregarding their alibis, and appreciating treachery and nocturnity as aggravating circumstances without sufficient proof.

On the identification and credibility of eyewitnesses: The Court held that the trial court's findings on the credibility of witnesses are accorded great weight and respect. Despite the defense's claims of inconsistencies and contradictions in the testimonies of Mariano and Dolores Cabael, the Court found their positive identification of the appellants as the perpetrators of the crime to be credible. The testimonies of Mariano and Dolores, who were relatives of the victim, provided a clear narration of the events, including the hacking of Magno and the mauling and abduction of Buenafe. The Court noted that Dolores was able to identify the accused as relatives, and Mariano positively identified them in court. The Court found no substantial facts or circumstances that were overlooked or misunderstood by the trial court that would materially affect the outcome of the case. The Court reiterated that the demeanor of witnesses is best observed by the trial court, which had the opportunity to assess their truthfulness. On the alibi of the accused: The Court found that the defense of alibi presented by FREDDIE and RICARDO failed to meet the requirements of time and place. The short distances and negligible travel times negated their alibi, especially in light of the positive identification by the eyewitnesses. On treachery: The Court affirmed the trial court's appreciation of treachery as a qualifying circumstance for murder. The attack on Magno was found to be sudden and unexpected, employing means that tended to insure the execution of the crime without risk to the offenders. The prosecution witnesses saw FREDDIE and RICARDO, armed with bolos, attack Magno without warning. They hacked the unsuspecting and unarmed victim, thus fulfilling the elements of treachery. The Court cited jurisprudence defining treachery as the employment of means, methods, or forms which tend directly and especially to insure the execution of the crime without risk to himself arising from the defense which the offended party might make. On nocturnity and dwelling as aggravating circumstances: The Court ruled that nocturnity was not sufficiently proven as an aggravating circumstance. There was no showing that the appellants deliberately sought out nighttime to facilitate the commission of the crime or to insure their escape. The testimonies indicated that lights were on in Magno's house, negating the notion that nighttime was especially sought or taken advantage of. Furthermore, the Court found that there was no definite testimony or evidence to prove that the house where the victim was killed was also his dwelling. The Court held that such a circumstance cannot be presumed, especially when it could lead to the imposition of the death penalty.
