The Antecedents: On May 24, 1993, Ronald Himor, a bank teller, was to pick up a cash deposit of P1,464,644.75 from Hi-Top Supermarket. He was accompanied by Emmanuel Gargaceran, a security guard. As they were about to cross the street back to the bank, two armed men emerged. One man took Gargaceran's handgun, while the other shot Gargaceran in the chest at close range. The armed men then demanded the duffle bag containing the money from Himor, who complied. Gargaceran died from the gunshot wound. Procedural History: An information for robbery with homicide was filed against Raymond Maxion y Gaspar and Carlos Villacruz. The case against Villacruz was dismissed for lack of evidence. Trial proceeded against Maxion, who pleaded not guilty. The Regional Trial Court (RTC), Branch 77, Quezon City, convicted Maxion of robbery with homicide and sentenced him to reclusion perpetua, ordering him to pay the supermarket for the stolen money and Gargaceran's heirs for indemnity, moral damages, and burial expenses.
