People v. Baldago
REITERATIONFacts
The Antecedents: On May 17, 1998, in Bukidnon, Florentino Casas was drinking wine with Cesar Oroyan at the store of Edilberto Ybañez. While waiting for another bottle, Guillermo Baldago suddenly stabbed Florentino Casas on the left breast. Almost simultaneously, Temoteo Madulen struck Florentino with a belt on the back, and Carlito Bangcas hit him with a piece of wood on the shoulder. Florentino ran inside the house, pursued by Baldago, who attempted to stab him again but was thwarted by Edilberto Ybañez pinning his hand. Romel Paje wrestled the knife from Baldago. Temoteo and Carlito then stoned the house before fleeing. Florentino Casas died before reaching the hospital. Procedural History: Guillermo Baldago, Temoteo Madulen, and Carlito Bangcas were charged with Murder. All pleaded not guilty. Baldago later withdrew his plea and entered a guilty plea, for which he was sentenced to reclusion perpetua and ordered to indemnify the heirs. Trial proceeded against Madulen and Bangcas. The Regional Trial Court (RTC) found Madulen and Bangcas guilty of murder, sentencing them to reclusion perpetua and ordering them to solidarily indemnify the heirs of Florentino Casas. The Petition: Accused-appellants Temoteo Madulen and Carlito Bangcas appealed their conviction, raising errors concerning the trial court's credence to conflicting prosecution testimonies and the finding of conspiracy.
Issue(s)
Whether the trial court erred in giving credence to the conflicting testimonies of the prosecution witnesses. Whether the trial court erred in convicting the accused for conspiring to commit murder.
Ruling
The Court affirmed the judgment of the trial court, finding accused-appellants Temoteo Madulen and Carlito Bangcas guilty of murder. They were sentenced to suffer the penalty of reclusion perpetua and to solidarily indemnify the heirs of Florentino Casas.
Ratio Decidendi
On the alleged conflicting testimonies of prosecution witnesses: The Court held that discrepancies in the testimonies of prosecution witnesses regarding minor details do not necessarily impair their credibility, especially when they coincide on material points. The alleged inconsistencies between Leonila Oroyan and Edilberto Ybañez, concerning the presence of other individuals and the details of the incident, were deemed minor. The Court emphasized that it is unnatural to expect exact congruence in the narration of events by different witnesses. Furthermore, declarations made in open court are given superior weight over affidavits, which are often incomplete and inaccurate. The material points on the participation of Madulen and Bangcas, namely that Madulen hit Casas with a belt and Bangcas struck him with a piece of wood, were consistently established by the prosecution witnesses. The Court found no ill motive for the witnesses to falsely implicate the accused-appellants. On the alleged lack of proof of conspiracy: The Court found the assignment of error to be without merit. Conspiracy was established by the unity of intention and purpose demonstrated by the accused-appellants' actions before, during, and after the incident. They were together prior to the incident, each armed with an instrument, and attacked the victim almost simultaneously. The fact that they were deterred from inflicting further injuries was due to the victim's escape, not their desistance. Their subsequent actions of stoning the house while Baldago was momentarily pinned and then fleeing together with Baldago further evinced their joint purpose and design. The Court reiterated the principle that where conspiracy is shown, the precise extent of each accused's participation is secondary, and the act of one is imputable to all conspirators, making their liability collective.
Main Doctrine
Conspiracy is sufficiently established by the unity of purpose and intention shown by the concerted actions of the accused before, during, and after the commission of the crime, even if their individual participation in inflicting injuries varied. The act of one conspirator is imputable to all.
