On the issue of identity and alibi: The Court held that the positive identification of the accused-appellant by the prosecution witnesses, namely Flora David, Dante David, and Josephine David, was sufficient to overcome the defense of alibi. The Court emphasized that alibi is the weakest defense and requires proof that the accused was so far away that he could not have been physically present at the crime scene. In this case, the distance between the accused's residence and the crime scene was only about 10 kilometers, and the accused could have easily traveled to and from the location on a motorcycle. The Court found the testimonies of the prosecution witnesses credible, noting that a startling or frightful experience can create an indelible impression. The Court also noted that the victim's relatives' identification was corroborated by their positive identification in court and, for Flora David, in a police lineup. This was established by the employment of a means of execution that gave the victim no opportunity to defend himself or retaliate, and the deliberate adoption of such means. The victim was shot four times while facing the assailant and waiting for a reply, without any warning, rendering him defenseless. On the awards for damages: The Court affirmed the award of P50,000.00 as civil indemnity for the death of Bonifacio David. The Court also awarded an additional P50,000.00 as moral damages, which can be awarded without further proof other than the death of the victim. However, the award of P100,000.00 as actual damages was deleted for lack of receipts to support the pecuniary loss.
