G.R. Nos. 140333-34 · 2001-12-11 · J. CURIAM, J.: · Primary: Criminal; Secondary: Family
REITERATION

Facts

The Antecedents: Accused Love Joy De Guzman was charged with two counts of statutory rape against his seven-year-old niece, Geneva Marie Daugherty. The first incident allegedly occurred in December 1998 and the second in February 1999. The victim testified that the accused lured her to his house, forced her to buy coffee, and then raped her. She initially did not report the incident due to threats from the accused. The second incident occurred when the accused again lured her to his house and raped her. After the second incident, she confided in a third party who brought her to the Barangay Hall, leading to a medical examination and the filing of a complaint. Procedural History: The Regional Trial Court of Angeles City, Branch 59, found the accused guilty beyond reasonable doubt of two counts of statutory rape and imposed the death penalty in each case. The accused was also ordered to indemnify the victim P75,000.00 in each case. The Petition: The accused appealed the decision, arguing that the Informations were defective for failing to specify the exact dates of the alleged rapes and that the prosecution failed to prove his guilt beyond reasonable doubt.

Issue(s)

Whether the Informations are fatally defective for failing to specify the exact dates of the alleged rapes. Whether the prosecution proved the guilt of the accused beyond reasonable doubt.

Ruling

The Supreme Court affirmed the judgment of the Regional Trial Court finding the accused Love Joy De Guzman guilty beyond reasonable doubt of two counts of rape. The death penalty imposed in each case was affirmed, with modifications to include additional awards for moral and exemplary damages. The Court ordered the accused to pay the victim P75,000.00 as indemnity, P50,000.00 as moral damages, and P25,000.00 as exemplary damages in each case. The case was forwarded to the Office of the President for possible clemency.

Ratio Decidendi

On the alleged defectiveness of the Informations: The Court held that the exact time and date of the commission of the rape are not essential elements of the crime. The gravamen of the offense is the fact of carnal knowledge under the circumstances enumerated in Article 335 of the Revised Penal Code. As long as the offense is alleged to have been committed at a time reasonably near the actual date, the information is sufficient. The Court cited People v. Felicito Barbosa y Turallo to support the principle that failure to recall the exact date is not an indication of false testimony and that the precise date is not an element of the offense. On the failure of the prosecution to prove guilt beyond reasonable doubt: The Court found the testimony of the seven-year-old complainant to be clear, spontaneous, and credible. The victim's account of the sexual assaults was detailed and consistent, even under intense cross-examination by the defense counsel and questioning by the trial court. The Court emphasized that testimonies of rape victims, especially child victims, are given full weight and credit because no one would willingly undergo the shame and humiliation of a public trial and medical examination if the accusation were false. The accused's defense of alibi was considered inherently weak and unreliable, especially when pitted against the positive identification by the victim. The Court noted that the minority of the victim and the relationship of maternal uncle were established and admitted, serving as qualifying circumstances for the crime of rape.

Main Doctrine

The testimony of a child victim, especially in cases of incestuous rape, is given full weight and credit due to the inherent shame and humiliation involved in such accusations. Alibi, being a weak and self-serving defense, cannot prevail over positive identification by the victim. The minority of the victim and the relationship between the offender and the victim are qualifying circumstances that warrant the imposition of the death penalty.
