Facts

No. 8294 amended the law, reducing the penalty for illegal possession of firearms to prision correccional in its maximum period. The respondent judge sentenced Zaldy Prado to an indeterminate prison term of two (2) years, eleven (11) months, and eleven (11) days to four (4) years, nine (9) months, and eleven (11) days, which was in accordance with R.A. No. 8294. Consequently, it became necessary for the respondent judge to fix a lower bail amount upon the accused's application for bail on appeal, as the circumstances enumerated in Rule 114, Section 5 of the Revised Rules of Criminal Procedure for denying bail were not present. The complainants' objection was based solely on the drastic reduction, which was explained by the considerable reduction in the penalty attached to the crime. On the delay in rendering a decision: The Court acknowledged the delay in the rendition of the decision, which was submitted for decision on February 14, 2000, and promulgated on September 11, 2000. However, it excused this delay, considering the heavy caseload of courts within the National Capital Judicial Region. The Court found nothing on record to indicate that the delay was malicious or caused with deliberate intent to inflict damage. The Office of the Court Administrator, which supervises lower courts, found the explanation acceptable, noting that a delay of about seven months could be excused given the circumstances. On the delay in transmittal of records: The Court found the explanation of Branch Clerk of Court Eva S. Nievales for the delay in transmitting the records to the Court of Appeals to be worthy of credence. The delay occurred after the accused filed a notice of appeal on September 20, 2000, and the records were transmitted on November 15, 2000. The explanation cited the court's designation as a Family Court effective September 1, 2000, necessitating an inventory of cases for unloading. This tedious task, coupled with the overwhelming influx of new Family Court cases, led to the disarray of records and justified the delay in transmittal, similar to the reasons excusing the delay in decision rendering.
