Facts

Ratio Decidendi

On the plea of self-defense and defense of stranger: The Court held that for self-defense to prosper, the accused must prove by clear and convincing evidence the elements of unlawful aggression on the part of the victim, reasonable necessity of the means employed to prevent or repel it, and lack of sufficient provocation on the part of the person defending himself. For defense of a stranger, the requisites are unlawful aggression by the victim, reasonable necessity of the means to prevent or repel it, and the person defending not being induced by revenge, resentment, or other evil motive. The Court found that accused-appellant failed to prove these elements. The evidence showed that the Vinculados were provoked by the actions of Mayor Galvez's party, not the other way around. Furthermore, there was no corroborating evidence to support the claim that the Vinculados were armed with a revolver and a knife; in fact, the physical evidence recovered by the police did not include such weapons. The Court emphasized that unlawful aggression must be an actual, sudden, and unexpected attack or imminent danger, not merely a threatening stance or oral threats. The nature and number of wounds suffered by the victims, particularly Alvin's four gunshot wounds on his back and Levi's severe injuries, demonstrated a determined effort to kill rather than to defend. On the conviction for murder and double frustrated murder: The Court found that the trial court did not err in its factual findings, which were supported by sufficient evidence. The accused-appellant's claim of self-defense was not substantiated and was contradicted by the physical evidence and the testimonies of witnesses. The Court reiterated that appellate courts accord the highest respect to the factual findings of trial courts in the absence of any showing that they were reached arbitrarily. The accused-appellant's act of fleeing and hiding after the incident further indicated his guilt and was incompatible with a claim of self-defense, as established in jurisprudence. On the award of damages: The Court affirmed the award of actual damages and civil indemnity for the death of Alvin Vinculado. However, the award of moral damages in the amount of Two Million Pesos was deemed excessive and reduced to P50,000.00 for each of the offended parties (Miguel Vinculado, Levi Vinculado, and the heirs of Alvin Vinculado), totaling P150,000.00, to compensate for injuries to their feelings. The award of attorney's fees was also reduced from P559,885.00 to P100,000.00, as the Court has the power to reduce such fees to render them reasonable and conscionable.
