People v. Delgado

G.R. No. L-12666 · 1917-08-30 · J. JOHNSON, J.: · Primary: Criminal; Secondary: Ethics
REITERATION

Facts

The Antecedents: The defendant, Jose Delgado, a councilman of Ligao, Albay, was charged with a violation of Article 28 of the Municipal Code. The municipality authorized the construction of certain streets and entered into contracts. Nominally, these contracts were with one Ramon Nieves. For the construction of one street, the municipality agreed to pay P246.25. However, the proof showed that the contracts with the laborers were actually made with the defendant, Jose Delgado, who paid them P80 for their labor. Ramon Nieves was merely the nominal contractor, receiving P5 from Delgado for allowing his name to be used. Procedural History: A complaint was filed in the justice of the peace court, leading to the defendant's arrest and a preliminary examination. The justice of the peace found probable cause and ordered the defendant to be held for trial in the Court of First Instance. The complaint was renewed in the Court of First Instance, where the defendant was tried, found guilty, and sentenced to six months imprisonment and costs. The Petition: The defendant appealed the decision of the Court of First Instance to the Supreme Court.

Issue(s)

Whether the lower court erred in disregarding the declaration of Ramon Nieves during the trial. Whether the evidence presented established the guilt of the defendant beyond a reasonable doubt for a violation of Article 28 of the Municipal Code.

Ruling

The Supreme Court affirmed the decision of the lower court, finding the defendant guilty of violating Article 28 of the Municipal Code and imposing the sentence of six months imprisonment and costs.

Ratio Decidendi

On the issue of disregarding Ramon Nieves' declaration: The lower court did not err in disregarding the declaration of Ramon Nieves during the trial. This is because Nieves had previously made a written confession (Exhibit A) before the trial, admitting that he was not the real contractor but that the defendant, Jose Delgado, was. By making contrary statements during the trial, Nieves discredited his own testimony. The court was justified in giving more weight to the prior written confession and other evidence presented. On the issue of guilt beyond a reasonable doubt: The evidence presented established beyond a reasonable doubt that the defendant was guilty of a violation of Article 28 of the Municipal Code. The record clearly showed that Ramon Nieves was merely the nominal contractor for the street construction, receiving P5 for allowing his name to be used. In reality, Jose Delgado was the actual contractor, entering into contracts with laborers and paying them for the work. This arrangement circumvented the proper procedures for municipal contracts and constituted a violation of the Municipal Code, as it indicated a potential for self-dealing and a disregard for the municipality's interests by a public officer. The sentence imposed by the lower court was found to be within the provisions of the Municipal Code, and therefore, no modification was necessary.

Main Doctrine

A public officer who enters into a contract in his own name but for the benefit of the municipality, thereby circumventing regulations and potentially engaging in self-dealing, is guilty of violating provisions of the Municipal Code prohibiting such conduct.
