People v. Masagnay
REITERATIONFacts
The Antecedents: On January 12, 1997, at around 10:00 PM, Romeo L. Garcia was attacked inside his house by Gonzalo Masagnay alias "Jun Masagnay" and several others. The assailants forcibly entered the house after kicking and breaking down the door. Gonzalo Masagnay allegedly stabbed Romeo Garcia with a "gulukan" on the right side of his body. Edwin Masagnay then hit Romeo Garcia with a lead pipe on the head and body until he fell. Subsequently, a certain Jun stabbed Romeo Garcia on the chest, and another assailant, "Pilong," dropped hollow blocks on the victim's face and body. The victim sustained multiple stab wounds and blows, which directly caused his death. Procedural History: Appellant Gonzalo Masagnay was charged with Murder. The Regional Trial Court (RTC), Branch 12, Lipa City, found him guilty beyond reasonable doubt as a co-conspirator and principal by direct participation, sentencing him to reclusion perpetua and ordering him to pay damages. The RTC based its decision primarily on the testimonies of the victim's wife, Estrella Garcia, and son, Rolando Garcia. The Petition: Appellant appealed the RTC decision, arguing that the RTC erred in finding him a co-conspirator and principal by direct participation, and in appreciating the aggravating circumstance of abuse of superior strength.
Issue(s)
Whether the appellant conspired with his co-accused in the commission of the crime of Murder. Whether the aggravating circumstance of abuse of superior strength attended the commission of the crime.
Ruling
The Supreme Court affirmed the decision of the RTC finding appellant Gonzalo Masagnay guilty of Murder, sentencing him to suffer the penalty of reclusion perpetua, with modifications as to the award of damages. The Court ordered the appellant to pay the heirs of Romeo L. Garcia P50,000.00 as civil indemnity, P50,000.00 as moral damages, P25,000.00 as temperate damages, and P25,000.00 as exemplary damages.
Ratio Decidendi
On the issue of conspiracy: The Court held that conspiracy can be inferred from the acts of the accused which clearly manifest a concurrence of wills and a common intent or design to commit a crime. In this case, the acts of the appellant and his co-accused in forcibly entering the victim's house, inflicting injuries one after another, and then fleeing, clearly demonstrated a common intent to kill Romeo Garcia. The Court emphasized that in conspiracy, it is sufficient that at the time of the aggression, all accused manifested a common intent or desire to attack, making the act of one the act of all. The precise degree of culpability of each accused is of no moment once conspiracy is proven, as each conspirator is responsible for all the acts of the others done in furtherance of the conspiracy. The appellant's participation in chasing the victim's son, Rolando, further indicated his involvement in the common design. On the issue of abuse of superior strength: The Court found that the qualifying circumstance of abuse of superior strength was amply established. The appellant and his three co-accused barged into the victim's house, forcibly broke down the door, and inflicted injuries on the unarmed victim one after another. This concerted action, where the attackers cooperated to secure the advantage of their combined strength to perpetrate the crime with impunity, clearly demonstrated a deliberate intent to take advantage of superior strength. The Court reiterated that to appreciate this circumstance, it is necessary to evaluate the physical conditions of the protagonists, the arms employed, and the incidents constituting the development of the event, all of which pointed to the use of excessive force out of proportion to the defense available to the victim.
Main Doctrine
Conspiracy is established by the concurrence of wills and common intent manifested by the acts of the accused, making each conspirator liable for the acts of the others in furtherance of the conspiracy. Abuse of superior strength is appreciated when the malefactors deliberately intended to take advantage of their combined strength to perpetrate the crime with impunity.
