Facts

The Antecedents: Petitioner Robert C. Casol was dismissed from the service by respondent Purefoods Corporation. The Processed Meats Division, to which Casol belonged, was subsequently closed on July 2, 1997. Procedural History: The Court of Appeals, in its May 19, 2004 decision and January 6, 2005 resolution, affirmed the dismissal. The Supreme Court, in a decision dated September 22, 2005, found Casol to have been illegally dismissed and ordered Purefoods Corporation to pay Casol separation pay equivalent to one (1) month pay or at least one-half (1/2) month pay for every year of service, with deductions for a 6-day suspension and the cost of repairing a company vehicle damaged due to Casol's infraction. The Petition: Petitioners prayed for full backwages from the time of illegal dismissal until the closure of the division and for separation pay to be computed at one and one-half month pay for every year of service. Respondent Purefoods Corporation moved for reversal, asserting substantial evidence warranted Casol's dismissal.

Ruling

The Supreme Court modified its previous decision. It ordered Purefoods Corporation to pay Casol full backwages, allowances, and other benefits computed from November 9, 1992, when these were withheld, until the closure of his department on July 2, 1997. The separation pay was to be computed at one month's pay or at least one-half month's pay for every year of service, whichever is higher, with the same deductions previously ordered. The motion for reconsideration of respondent was denied for lack of merit.

Ratio Decidendi

On the entitlement to full backwages, allowances, and other benefits: The Court reiterated the mandate of Article 279 of the Labor Code, which states that an employee unjustly dismissed is entitled to reinstatement without loss of seniority rights and privileges, and to his full backwages, inclusive of allowances, and to his other benefits or their monetary equivalent computed from the time his compensation was withheld from him up to the time of his actual reinstatement. In this case, since reinstatement was no longer feasible due to the closure of the department, Casol was entitled to full backwages, allowances, and other benefits. The Court noted that while its previous decision granted separation pay in lieu of reinstatement and full backwages, the payment of full backwages, allowances, and other benefits was not explicitly mentioned in the dispositive portion, necessitating modification to include it. The Court clarified that these benefits should be computed from November 9, 1992, when his compensation was withheld, up to July 2, 1997, the date of the closure of his department. On the computation of separation pay: The Court held that no evidence was presented by the petitioners other than Casol's bare allegation that the respondent awarded separation pay to its employees at the rate of one and one-half month for every year of service. Without sufficient evidence to support this claim, the Court could not order a computation basis other than what is provided under the Labor Code, which is one month's pay or at least one-half month's pay for every year of service, whichever is higher. The Court thus maintained the computation basis for separation pay as previously determined, while modifying the award to include full backwages.
