Ratio Decidendi
On the issue of consolidation and the COMELEC First Division's decision: The Court found no merit in the petitioner's contention that the COMELEC First Division committed grave abuse of discretion. The rule on consolidation of cases is permissive, not mandatory. The two cases, SPC No. 04-087 (pre-proclamation controversy regarding the ERs) and SPC No. 04-124 (annulment of proclamation), did not involve similar questions of law and fact, thus consolidation was inappropriate. SPC No. 04-087 concerned the validity of the ERs themselves, while SPC No. 04-124 concerned the premature conduct of the MBC in proclaiming a candidate. The mere pendency of both cases before the same division does not necessitate consolidation. Therefore, the First Division correctly proceeded to decide SPC No. 04-124. On the validity of the proclamation: The Court affirmed that the COMELEC First Division correctly annulled the proclamation. At the time of the proclamation, the COMELEC First Division had not yet resolved SPC No. 04-087. Pursuant to Section 36(i) of COMELEC Resolution No. 6669, the MBC should not have proclaimed petitioner without COMELEC authorization. Any proclamation made under such circumstances is void ab initio. The exception, that the contested returns will not adversely affect the election results, was not met because the total votes in the 26 contested ERs (5,178) were higher than petitioner's lead (762 votes) based on uncontested ERs, indicating that the results could be adversely affected. On the COMELEC En Banc's order for a new MBC and re-canvass: The Court found that the COMELEC En Banc gravely abused its discretion by ordering a new MBC to re-canvass all ERs and proclaim the winner. This action, taken before the First Division could decide SPC No. 04-087, effectively rendered a decision on the merits of a pre-proclamation controversy still pending before a Division. This violates the constitutional mandate that election cases must first be heard and decided by a Division of the COMELEC, and the En Banc does not have the authority to hear and decide cases at the first instance. Therefore, this specific order of the En Banc was set aside.
