REITERATION

Facts

1. The Antecedents: The underlying dispute involves the brutal killing of Bonifacio Malgana. The deceased was living with his wife, Antonia Patricio, with whom he had an unhappy marriage. Patricio had an illicit relationship with Jose Malgana, and she, along with Jose Malgana and Patricio's mother, Antonina Manangan, conspired to kill Bonifacio. The plan involved hiring a man named Marcelo Miguel to commit the murder, but he refused. Ultimately, on the night of December 17, 1922, Jose Malgana and Domingo Bestro went to the deceased's home, where they, along with Antonia Patricio and Antonina Manangan, strangled Bonifacio Malgana and inflicted other violent injuries. The body was subsequently buried near the house and attempts were made to conceal the crime. 2. Procedural History: Following an investigation prompted by suspicions raised by Marcelo Miguel, four individuals, including Antonia Patricio, Jose Malgana, Antonina Manangan, and Domingo Bestro, were arrested. Domingo Bestro confessed and revealed the details of the murder, leading to the exhumation of Bonifacio Malgana's body. The Court of First Instance of Tarlac found Antonia Patricio guilty of parricide and sentenced her to reclusion perpetua. In a separate case, Jose Malgana and Antonina Manangan were found guilty as accomplices in simple homicide and sentenced to eight years and one day of prision mayor, with an order to indemnify the heirs of the deceased. Both judgments were appealed. 3. The Petition: The appeals in G.R. No. 20651 and G.R. No. 20652 were consolidated and presented to the Supreme Court. The appellants sought to reverse the judgments of the lower court. The Supreme Court reviewed the evidence, including confessions and the discovery of the body, confirming the participation of all appellants in the killing. The Court determined that Antonia Patricio committed parricide, while Jose Malgana and Antonina Manangan, despite their participation in the killing of a husband of their co-accused, were guilty of murder, not parricide, due to established legal doctrine. The Court affirmed the sentence for Patricio but reversed the judgment for Malgana and Manangan, sentencing them for murder with appropriate penalties and indemnification.

Issue(s)

Whether the appellants are guilty of parricide, murder, or homicide. Whether the aggravating circumstances of premeditation, treachery, nocturnity, and abuse of superior strength were present. Whether the crime was committed in the dwelling of the deceased.

Ruling

The judgment in case G.R. No. 20651, sentencing Antonia Patricio to reclusion perpetua, is affirmed. The judgment in case G.R. No. 20652, adjudging Jose Malgana and Antonina Manangan as accomplices in simple homicide, is reversed. Jose Malgana and Antonina Manangan are declared guilty of murder, with Jose Malgana sentenced to cadena perpetua and Antonina Manangan to reclusion perpetua. They are jointly and severally ordered to indemnify the heirs of the deceased in the sum of P1,000.

Ratio Decidendi

On the classification of the crime and the guilt of the appellants: The Court affirmed the conviction of Antonia Patricio for parricide, recognizing her direct participation as the wife of the deceased. For Jose Malgana and Antonina Manangan, the Court clarified that a stranger participating in parricide is not guilty of parricide itself, but of murder or homicide depending on the attendant circumstances. The Court found that their participation, coupled with the manner of killing, constituted murder. The Court noted that all four accused participated as principals in the killing, with their confessions corroborated by the discovery of the body. On the presence of aggravating circumstances: The Court found that the crime committed by Antonia Patricio was parricide, with the aggravating circumstances of known premeditation, treachery, nocturnity, and abuse of superior strength. For Antonina Manangan and Jose Malgana, the crime was murder, qualified by treachery. As to both, the aggravating circumstances of nocturnity, abuse of superior strength, and commission in the dwelling of the deceased were appreciated. Furthermore, known premeditation was appreciated against Antonina Manangan, as she had accompanied Antonia Patricio in hiring Marcelo Miguel. On the penalty to be imposed: Due to the formidable array of aggravating elements and the atrocious nature of the crime, the Court considered the death penalty. However, due to the lack of unanimous concurrence for the death penalty among the Justices, the penalty next below death, as required by Act No. 2726, was imposed. Antonia Patricio received reclusion perpetua for parricide. Jose Malgana and Antonina Manangan received cadena perpetua and reclusion perpetua, respectively, for murder, reflecting the severity of their participation and the aggravating circumstances.

Main Doctrine

A stranger who participates in the perpetration of parricide is not guilty of parricide but only of murder or homicide according to the factors present in the offense. The crime committed by Antonina Manangan and Jose Malgana is murder, qualified by treachery, with aggravating circumstances of nocturnity, abuse of superior strength, and commission in the dwelling of the deceased. Antonina Manangan is further appreciated with known premeditation.
