The Antecedents: On January 30, 1996, at around 1:30 a.m., Emeldo Obina and Carlito Balagbis barged into the room of AAA and her common-law husband BBB, demanding money. AAA gave them ₱800.00. Balagbis poked BBB with a knife while Obina mashed AAA's breasts and fingered her. Amado Ramirez, whose voice was recognized by the couple, shouted from under the house, threatening to kill BBB. Fearing for his life, BBB jumped out the window and fled. While Obina and Balagbis chased BBB, Obina had carnal knowledge of AAA against her will. Obina then forced AAA to go with him, but she escaped when dogs barked. BBB sought police assistance, and later, the police arrived. Procedural History: The accused were charged with robbery with rape. The RTC found Emeldo Obina guilty of robbery with rape and sentenced him to reclusion perpetua. Carlito Balagbis and Amado Ramirez were found guilty as co-principals of robbery and sentenced to imprisonment. The CA affirmed the RTC decision with modification, ordering Obina to pay civil indemnity. The accused Obina and Ramirez appealed. On the conviction of appellant Obina for robbery with rape, and appellants Ramirez and accused Balagbis for robbery: The Court held that the findings of the trial court on the credibility of witnesses are accorded great respect, and there was no compelling reason to deviate from this rule. The RTC and CA committed no reversible error in finding appellant Obina guilty of robbery with rape, and appellants Ramirez and accused Balagbis guilty of robbery. The elements of robbery were established. The rape was committed on the occasion of the said robbery. The presence of conspiracy was also evident from the concerted actions of the accused.
