Facts

The Antecedents: On October 3, 2001, four armed individuals forcibly entered the residence of spouses BBB and CCC. They accosted the household members, including AAA, a 17-year-old househelper, bound them, and blindfolded them. AAA was brought to the comfort room by appellant Joseph Evangelio and another robber, where she was stripped and her head was banged against the wall, causing her to lose consciousness. Upon regaining consciousness, she found herself on the floor, untied, with her shorts and panty strewn beside her, experiencing pain and bleeding from her vagina. The perpetrators stole personal properties and jewelry valued at approximately PhP336,000.00. Procedural History: The Regional Trial Court (RTC) found appellant Joseph Evangelio guilty beyond reasonable doubt of Robbery with Rape and sentenced him to death, ordering him to pay damages. Upon appeal, the Court of Appeals (CA) affirmed the conviction, modifying the penalty to reclusion perpetua without parole due to the abolition of the death penalty and deleting certain damages not alleged in the Information. The CA also did not consider the aggravating circumstances of nighttime and unlawful entry but appreciated the aggravating circumstances of band and dwelling. The Petition: Appellant Joseph Evangelio appealed the CA decision to the Supreme Court, asserting his innocence and interposing alibi as a defense. He claimed he was sleeping at his house at the time of the incident.

He is ordered to return the stolen items or pay their value, and to pay civil indemnity, moral damages, and exemplary damages to AAA.

Ratio Decidendi

On the guilt of the accused-appellant for the crime of Robbery with Rape: The Court found that the elements of robbery with rape were established. The prosecution proved the unlawful taking of personal property with violence and intimidation, the intent to gain, and the commission of rape on the occasion of the robbery. While AAA did not witness the actual rape due to unconsciousness, the Court held that circumstantial evidence, including her physical state (bleeding vagina, pain, lacerations) and the sequence of events (being taken to the comfort room, stripped, and losing consciousness after resistance), sufficiently established the rape. The Court cited previous rulings where conviction was based on similar circumstantial evidence. The Court also found conspiracy among the perpetrators, evidenced by their coordinated actions from entry to exit, making the act of one the act of all. On the defense of alibi: The Court found the defense of alibi to be unmeritorious. The appellant's claim of being asleep at his house was unsubstantiated by any other witness, and it was not physically impossible for him to be at the scene of the crime, as Diit, Tacloban City, was only a one-hour ride away. The Court reiterated that alibi must be proven with clear and convincing evidence and must show physical impossibility of presence at the crime scene, which was not met in this case. Positive identification by prosecution witnesses, which was found credible by the lower courts, prevails over a bare denial and unsubstantiated alibi. On the aggravating circumstances of band and dwelling: The Court affirmed the CA's ruling that the aggravating circumstances of band and dwelling were correctly appreciated. The presence of four armed individuals (one with a handgun, others with knives) established the aggravating circumstance of a band. The commission of the crime inside the victims' dwelling, without provocation, established the aggravating circumstance of dwelling, emphasizing the sanctity of privacy and the increased culpability when an offense is committed within a person's abode. On the awarded damages: The Court modified the awards. It ordered the appellant to return the stolen jewelry and valuables or pay their value of PhP336,000.00 to spouses BBB and CCC. The award of moral damages to BBB and CCC was deleted for lack of evidence of their moral suffering. AAA was awarded PhP75,000.00 as civil indemnity and PhP75,000.00 as moral damages (increased from the CA's award), and PhP30,000.00 as exemplary damages due to the presence of aggravating circumstances. Interest at 6% per annum was imposed on all damages from finality of judgment. The CA's deletion of damages awarded to Edelyn was affirmed as she was not named as a complainant in the Information.

Main Doctrine

Circumstantial evidence is sufficient to sustain a conviction for rape when the circumstances proved form an unbroken chain that results in a conviction beyond reasonable doubt, even if the victim was unconscious during the commission of the act. For robbery with rape, it must be shown that the rape was committed by reason or on the occasion of the robbery, not the other way around.
