Facts

The Antecedents: Anastacio N. Teodoro III filed a disbarment complaint against Atty. Romeo S. Gonzales. Atty. Gonzales represented Araceli Teodoro-Marcial in two civil cases filed against Anastacio. The first case, Special Proceeding No. 99-95587, involved the settlement of the intestate estate of Manuela Teodoro. While this proceeding was pending, Atty. Gonzales assisted Teodoro-Marcial in filing Civil Case No. 00-99207 for Annulment of Document, Reconveyance and Damages, without disclosing the pendency of the special proceeding. Procedural History: The disbarment complaint was referred to the Commission on Bar Discipline of the Integrated Bar of the Philippines (IBP) for investigation. The Investigating Commissioner found Atty. Gonzales administratively liable for forum shopping, recommending a one-month suspension. However, the IBP Board of Governors reversed this recommendation and dismissed the case for lack of merit. The Petition: The Supreme Court reviewed the case to determine if Atty. Gonzales committed forum shopping and violated the Code of Professional Responsibility.

Ruling

Ratio Decidendi

On the issue of forum shopping: The Court held that Atty. Gonzales committed forum shopping. Forum shopping is defined as the act of filing multiple suits that involve the same parties, causes of action, and reliefs, either to secure a favorable judgment or to harass the opposing party. The Court applied the test for litis pendentia and res judicata, which requires the identity of parties, causes of action, and reliefs sought. In this case, there was an identity of parties, as the heirs of Manuela Teodoro were the initiating parties in both the Special Proceeding and the Civil Case, and Anastacio was the oppositor/defendant in both. The causes of action were also identical because the central issue in both cases was whether Manuela Teodoro held the Malate property in trust for the heirs, and the same evidence would be required to prove or disprove this claim. Although the reliefs sought were different in form (settlement of estate versus annulment of sale), a ruling in one case would have resolved the other, thus satisfying the identity of relief element. The Court noted that Atty. Gonzales's act of filing the second case without disclosing the pending first case, and advising his client to execute an affidavit of non-forum shopping, constituted misconduct and a violation of his duty to promote respect for the law. On the violation of the Code of Professional Responsibility: The Court found that Atty. Gonzales violated Canon 1 of the Code of Professional Responsibility, which mandates lawyers to obey the laws of the land and promote respect for the law and legal processes. His act of forum shopping also contravened his duty to assist in the speedy and efficient administration of justice and the prohibition against unduly delaying a case by misusing court processes. The Court cited the pronouncements against forum shopping due to its tendency to clog court dockets and lead to conflicting rulings. While disbarment was considered too harsh, the Court found that censure was the appropriate penalty, drawing a parallel to previous cases where similar misconduct resulted in censure.
