Issue(s)

Whether the prosecution sufficiently established the guilt of the accused-appellants beyond reasonable doubt for the complex crime of Murder with Direct Assault. Whether conspiracy was proven among the accused-appellants. Whether the killing was attended by the qualifying circumstances of evident premeditation and treachery. Whether the victim, Floro A. Casas, was a person in authority or an agent of a person in authority, and if the assault was committed by reason of his performance of his duties.

Ruling

The case against Ex-Mayor Carlos Estonilo, Sr. was dismissed due to his death during the pendency of the appeal. The Court modified the monetary awards, increasing the civil indemnity and moral damages to ₱100,000.00 each, and awarded ₱100,000.00 as exemplary damages, with legal interest.

Ratio Decidendi

On the guilt of the accused-appellants beyond reasonable doubt for Murder with Direct Assault: The Court sustained the conviction, finding that the prosecution successfully established all the elements of murder and direct assault. The killing of Floro A. Casas was proven, and the accused-appellants were identified as perpetrators. The Court found that the killing was attended by evident premeditation and treachery. Furthermore, Floro Casas, as a District Supervisor, was a person in authority, and the assault was committed by reason of his performance of his duties, thus constituting direct assault. The complex crime of Murder with Direct Assault was therefore established. On the existence of conspiracy: The Court found that the prosecution adequately established conspiracy among the accused-appellants. The testimonies of prosecution witnesses, particularly Servando and Antipolo, demonstrated a unity of purpose and a common criminal design to kill Floro Casas. Servando testified to overhearing the planning of the murder, while Antipolo witnessed the actual shooting and the subsequent actions of the accused. The coordinated actions of the gunmen, lookouts, and those providing backup indicated a conspiracy. On the qualifying circumstances of evident premeditation and treachery: The Court held that evident premeditation was proven by the testimony of Servando, who was present during the planning stages of the murder on two separate occasions. The Court also found treachery to be present, noting that the victim was attacked successively with firearms at close range, affording him no chance to defend himself. The presence of backup gunmen and lookouts further demonstrated that the attack was deliberate, unexpected, and executed without risk to the assailants. On Floro Casas being a person in authority and the assault being by reason of his duties: The Court clarified that Floro A. Casas, as a District Supervisor of Public Schools, was a person in authority. The finding of direct assault was based on the fact that the attack on him was committed by reason of his performance of his duties as such supervisor. The motive for the killing, linked to Floro's support for a political candidate and his role in processing vouchers, underscored that the assault was connected to his official functions, thereby satisfying the elements of direct assault.

Main Doctrine

The Supreme Court affirmed the conviction of the accused-appellants for the complex crime of Murder with Direct Assault, holding that the prosecution established the elements of murder, including the qualifying circumstances of evident premeditation and treachery, and direct assault by reason of the victim's performance of his duty as a public officer. The Court also reiterated that alibi and denial are weak defenses when faced with positive identification by credible witnesses.
