The Antecedents: Nicetas Tanieza-Calayoan filed an administrative complaint against her husband, Elmer Jerry C. Calayoan, a Process Server, for Disgraceful and Immoral Conduct. Nicetas alleged that Elmer Jerry abandoned her and their two children since May 18, 2005, and was having an illicit affair with Rina Balboa. Nicetas claimed she and their daughter Jenny Ann saw Elmer Jerry and Rina in Angono, Rizal on August 5, 2005, where Rina admitted to being three months pregnant. Nicetas also alleged a prior illicit relationship with Rosemarie Jacquias, attaching a Minutes of Meeting and a promissory note from Rosemarie admitting the relationship. Elmer Jerry again denied these allegations, explaining a picture with Rina was from a wedding and baptism event, and claimed no knowledge of Rina's child. Procedural History: The administrative matter was referred to the Executive Judge of the RTC at Bucay, Abra, for investigation. The investigation was handled by multiple judges due to retirements and transfers, with Judge Gabino B. Balbin, Jr. eventually concluding the investigation and submitting his findings.
