The Antecedents: Apolonio Kho was the registered owner of a parcel of land. A portion of this land was placed under the Operation Land Transfer Program pursuant to Presidential Decree No. 27. The Land Bank of the Philippines (LBP) processed claims and offered valuations for portions of the land, which Apolonio rejected. The LBP deposited the offered amounts. Subsequently, the Office of the Provincial Adjudicator of the Department of Agrarian Reform Adjudication Board (PARAD) fixed the value of the land. Emancipation Patents were issued to farmer-beneficiaries, partially cancelling Apolonio's title. Procedural History: The LBP appealed the PARAD's order to the Department of Agrarian Reform Adjudication Board (DARAB), which affirmed the PARAD's decision. The LBP then filed a petition for the determination of just compensation before the Regional Trial Court (RTC). Due to the passage of Republic Act No. 9700 and its implementing guidelines, the respondents moved for a revaluation, which the RTC granted. The case was transferred to the RTC acting as a Special Agrarian Court (SAC). The LBP submitted a revaluation report. The RTC appointed Commissioners who submitted an Appraisal Report fixing the just compensation. The RTC adopted the Commissioners' valuation, ordered the deduction of the initial deposit, and imposed a 12% legal interest on the unpaid balance, also ordering the LBP to pay its share of the Commissioners' fees. The Court of Appeals (CA) affirmed the RTC ruling. The Petition: The LBP filed a petition for review on certiorari assailing the CA's decision.

On the determination of just compensation, time of taking, and application of Section 17 of RA 6657: The Court held that when the acquisition process under Presidential Decree No. 27 is still incomplete, specifically when just compensation has yet to be settled, the determination and conclusion of the process must be done under Republic Act No. 6657, as amended. For claims where claim folders were received by the LBP prior to July 1, 2009, just compensation shall be determined in accordance with Section 17 of Republic Act No. 6657, as amended, prior to its further amendment by Republic Act No. 9700, pursuant to the cut-off date set under DAR Administrative Order No. 2, series of 2009. The Court noted that the RTC and CA neither considered this cut-off rule nor explained their deviation from it. Therefore, the RTC should have computed just compensation using pertinent DAR regulations applying Section 17 of Republic Act No. 6657 prior to its amendment by Republic Act No. 9700, absent any cogent justifications otherwise. The Court emphasized that while the RTC, acting as a Special Agrarian Court (SAC), is not strictly bound by DAR formulas, it must explain and justify in clear terms any deviation from prescribed factors and formulas. The Court found it necessary to remand the case to ensure compliance with the law and to give everyone their due. The Court reiterated that just compensation must be valued at the time of taking, which is when the owner was deprived of the use and benefit of his property. In this case, this was when emancipation patents were issued in the names of the farmer-beneficiaries on May 27, 2002. Therefore, evidence presented for valuation must be based on values prevalent at that time for similar agricultural lands. The Court directed that just compensation must be arrived at pursuant to the guidelines set forth in Section 17 of Republic Act No. 6657, as amended, prior to its amendment by Republic Act No. 9700. The RTC is reminded that while it should consider DAR formulas, it is not strictly bound by them if the situations do not warrant their application. Any deviation must be clearly explained and justified. On the award of legal interest and Commissioners' fees: The Court stated that interest may be awarded as warranted by the circumstances and based on prevailing jurisprudence. Legal interest on the unpaid balance shall be pegged at 12% per annum from the time of taking on May 27, 2002, until June 30, 2013. Thereafter, from July 1, 2013, until fully paid, the just compensation shall earn interest at the new legal rate of 6% per annum, in line with BSP-MB Circular No. 799, series of 2013. The Court affirmed that the charge of Commissioners' fees against the LBP is in accordance with Section 16, Rule 141 of the Rules of Court, and the amount of P30,000.00 was fair and commensurate to the work performed.
