The Antecedents: Spouses Geraldy and Lilibeth Victory (Spouses Victory) were enticed by respondent Atty. Marian Jo S. Mercado to enter into financial transactions with her, promising good monetary returns. Spouses Victory entrusted money to respondent for investment and management. Initially, the transactions were profitable for about 10 months. However, respondent later became evasive in returning the money and failed to settle and account for the funds entrusted to her. Spouses Victory alleged an outstanding obligation of PhP 5 Million plus interest, totaling PhP 8.3 Million. Spouses Victory filed a criminal complaint for estafa and violation of Batas Pambansa Blg. 22. Subsequently, respondent proposed to reduce her obligation to PhP 7.5 Million and issued three postdated checks for PhP 300,000 each, which all bounced. Procedural History: The Integrated Bar of the Philippines (IBP)-Commission on Bar Discipline (CBD) found that respondent lured Spouses Victory into financial transactions with a promise of profit, which she failed to deliver. The IBP-CBD recommended respondent's suspension for six (6) months. The IBP Board of Governors adopted and approved the recommendation with modification, disbarring respondent for violating Canon 7 of the Code of Professional Responsibility and for evading settlement of her financial obligations. Respondent's motion for reconsideration was denied, but the penalty was modified to suspension from the practice of law for one (1) year, considering her settlement efforts and apology. The Petition: This case involves a disbarment complaint against respondent Atty. Marian Jo S. Mercado for alleged violation of the Code of Professional Responsibility and the Lawyer's Oath.

Ruling
The Supreme Court resolved to SUSPEND Atty. Marian Jo S. Mercado from the practice of law for one (1) year, to commence immediately upon receipt of the Decision, with a WARNING that a repetition of the same or similar offense will warrant a more severe penalty.
Ratio Decidendi
On Whether the respondent should be held administratively liable based on the allegations in the pleadings of all parties on record: Emphatically, yes. A lawyer shall at all times uphold the integrity and dignity of the legal profession, maintaining a high standard of legal proficiency as well as honesty and fair dealing. Canon 1, Rule 1.01, and Canon 7 of the Code of Professional Responsibility are clear on this. Rule 1.01 states that a lawyer shall not engage in unlawful, dishonest, immoral or deceitful conduct, while Canon 7 mandates that a lawyer shall at all times uphold the integrity and dignity of the legal profession and support the activities of the Integrated Bar. The Court has consistently imposed penalties of suspension or disbarment for gross misconduct, whether in a professional or private capacity, as good character is an essential qualification for the practice of law. In this case, it is undisputed that respondent has an outstanding obligation with Spouses Victory due to failed investment deals, and she issued bouncing checks to settle this obligation. This deliberate failure to pay just debts and the issuance of worthless checks constitute gross misconduct. The Court cannot exempt respondent from liability due to financial difficulties, especially since she admitted to continuing business despite hardships, leading to accumulating obligations. Her actuations fell short of the exacting standards expected of a lawyer. While she admitted responsibility and intended to comply, her infractions cannot be ignored. To uphold the integrity of the legal profession, the findings and sanction imposed by the IBP Board of Governors are affirmed, with modification in the penalty.
