G.R. No. 27040 · 1927-09-29 · J. ROMUALDEZ, J.: · Primary: Criminal; Secondary: Public Officers
REITERATION

Facts

The Antecedents: The accused, Faustino Garalde, an assistant postmaster, allegedly conspired with others to commit estafa with falsification of commercial documents. Specifically, they are accused of appropriating postal money orders Nos. 99014 and 99015, totaling $160, intended for Cosme Valdes. This appropriation was allegedly achieved by falsifying the money orders, including counterfeiting the signature of Cosme Valdes, to their own gain and to the damage of the payee. Procedural History: The Court of First Instance of Ilocos Norte found Faustino Garalde guilty as principal of estafa with falsification of official documents and Candido Aguillon as an accomplice. Garalde was sentenced to ten years and one day of prision mayor, perpetual disqualification, and a fine. Aguillon received a lesser sentence. Both were ordered to indemnify certain post-offices. Faustino Garalde appealed the decision. The Appeal: The appellant, Faustino Garalde, based his appeal on two assignments of error concerning the sufficiency of the evidence presented against him.

Issue(s)

Whether the evidence presented was sufficient to prove the guilt of the appellant, Faustino Garalde, for estafa with falsification of public documents. Whether the acts committed by the appellant constituted malversation of government funds in addition to falsification.

Ruling

The Supreme Court modified the judgment of the lower court. The appellant, Faustino Garalde, was found guilty of both malversation of government funds and falsification of public documents. He was sentenced to eight years and one day of prision mayor for falsification, with accessories, perpetual disqualification, and a fine, and to two years imprisonment for malversation, with accessories, perpetual disqualification, and a fine, with subsidiary imprisonment in case of insolvency. The personal penalties were ordered not to be served simultaneously. The appellant was also ordered to indemnify the Government.

Ratio Decidendi

On Issue 1: The Court found that the evidence presented sufficiently established the guilt of the appellant, Faustino Garalde, beyond a reasonable doubt. The evidence showed that the appellant, in conspiracy with his co-accused and taking advantage of his position as assistant postmaster, falsified public documents, specifically postal money orders Nos. 99014 and 99015. These money orders, amounting to $100 and $60 respectively, were received by the appellant by reason of his office. The Court concluded that the appellant's actions constituted the crimes of malversation of government funds and falsification of public documents, both of which were adequately alleged, described, and proven during the trial. The sufficiency and legality of the charges were not questioned. On Issue 2: The Court held that the amounts abstracted and appropriated by the accused were Government funds, as defined by section 658 of the Administrative Code. Therefore, the appellant committed malversation of Government funds in addition to the falsification of public documents. Both crimes were sufficiently alleged and proven. The Court decided to modify the judgment of the lower court to reflect convictions for both offenses, imposing separate penalties for each, which were not to be served simultaneously, in accordance with the principles of penal law.

Main Doctrine

The Supreme Court affirmed the conviction of an assistant postmaster for malversation of government funds and falsification of public documents. The Court held that the accused, by taking advantage of his position and conspiring with others, unlawfully appropriated postal money orders intended for Cosme Valdes through falsification, thereby defrauding the government. The conviction was based on sufficient evidence proving guilt beyond reasonable doubt, and the penalties for both crimes were imposed.
