Facts

The Antecedents: This case consolidates three administrative matters concerning the 4th Shari'a Circuit Court (SCC) in Maimbung, Sulu. The first matter, A.M. No. SCC-10-14-P, involves charges by Presiding Judge Bensaudi A. Arabani, Jr. against Junior Process Server Rahim A. Arabani and Utility Worker I Abduraji G. Bakil for conduct unbecoming a court employee, dishonesty, and insubordination. These charges stemmed from allegations that Bakil punched Rahim's bundy card on multiple occasions, despite warnings. The second matter, A.M. No. SCC-10-15-P, also initiated by Judge Arabani, charges Clerk of Court Rodrigo Ramos, Jr. with conduct unbecoming a court employee, citing his alleged failure to be at his assigned table, roaming the office, not attending to work, refusing to place his bundy card on the designated rack, and improperly filling out leave applications. The third matter, A.M. No. SCC-11-17, comprises counter-charges filed by Rahim, Abduraji, and Rodrigo against Judge Arabani, including allegations of absences without leave, tolerating family members' tardiness, sexual harassment, and displaying offensive drawings. Sheldalyn I. Maharan also filed a sexual harassment complaint against Judge Arabani. Procedural History: The initial complaints were filed through letters and affidavits by Judge Arabani and the court staff. These matters were consolidated by the Supreme Court and referred for joint investigation and recommendation to the Presiding Judge of the Regional Trial Court of Jolo, Sulu, Branch 3. The Investigating Judge submitted a report with findings and recommendations. Subsequently, the Supreme Court referred this report to the Office of the Court Administrator (OCA) for evaluation. The OCA adopted the findings of the Investigating Judge and made its own recommendations regarding the penalties and resolutions of the charges. The Petition: The Supreme Court, in its decision, reviewed the findings and recommendations of the OCA and the Investigating Judge. It adopted the factual findings of the OCA but differed in some conclusions and imposed penalties. The Court found Rahim and Abduraji guilty of dishonesty for irregularities in punching Rahim's bundy card and suspended them for six months without pay. Rodrigo was found guilty of violating office rules and frequent unauthorized absences, leading to a reprimand and a suspension of six months and one day. Judge Arabani was found guilty of sexual harassment for making an offensive drawing and was suspended for six months without pay. Other charges were dismissed for lack of merit, insufficient evidence, or being rehashes of previously resolved issues.

Ruling

The Supreme Court adopted the factual findings of the OCA but differed in some conclusions and penalties. The Court ruled on each case as follows: 1. A.M. No. SCC-10-14-P: Rahim A. Arabani and Abduraji G. Bakil were found guilty of dishonesty for punching Rahim's bundy card/DTR on three occasions. They were suspended for six (6) months without pay, with a stern warning. The charges for insubordination and conduct unbecoming were dismissed for lack of merit. No. SCC-11-17: The charges of sexual harassment against Judge Arabani were dismissed for insufficiency of evidence, except for the act of drawing a vagina and a penis. Judge Arabani was found guilty of sexual harassment, classified as a less grave offense, and was suspended for six (6) months without pay, with a stern warning. The other charges were dismissed as a rehash of previous issues or unsubstantiated.

Ratio Decidendi

On the charge of dishonesty against Abduraji and Rahim (A.M. No. SCC-10-14-P): The Court affirmed the OCA's ruling that Abduraji and Rahim were guilty of dishonesty for the irregularities in punching Rahim's bundy card/DTR on three occasions. The Court emphasized that the punching of a DTR is a personal act and cannot be delegated. His reasons for keeping the bundy cards were deemed unconvincing. This violation is a light offense, but coupled with his failure to secure the Judge's signature on his bundy cards, the Court reprimanded him and sternly warned him against similar acts. On Rodrigo Ramos, Jr.'s frequent unauthorized absences and loafing (A.M. No. SCC-10-15-P): Contrary to the OCA's finding, the Court found Rodrigo guilty of loafing or frequent unauthorized absences from duty during regular hours. The Court noted his numerous unauthorized monthly absences from April to September 2010, exceeding the allowable leave credits. The Court emphasized that court personnel must strictly observe official time. As this was Rodrigo's first offense for this matter, the Court imposed a suspension of six (6) months and one (1) day without pay, modifying the OCA's recommendation for forfeiture of salary. On the charges against Judge Arabani (A.M. No. SCC-11-17): The Court upheld the Investigating Judge's finding that most charges were a rehash of previously resolved issues and lacked sufficient corroborating evidence. The sexual harassment charge by Sheldalyn was dismissed for insufficiency of evidence. However, the Court found Judge Arabani guilty of sexual harassment for making a drawing of a vagina and a penis and showing it to Sheldalyn, corroborated by Mirad. This act was classified as a less grave offense under Section 53 (B) (5) of CSC Resolution No. 01-0940, analogous to verbal abuse with sexual overtones, creating an intimidating, hostile, or offensive environment. For this, Judge Arabani was suspended for six (6) months without pay, with a stern warning.

Main Doctrine

The punching of a court employee's Daily Time Record (DTR) is a personal act that cannot be delegated. Falsification of DTRs constitutes dishonesty and renders the employee administratively liable. Unauthorized absences, especially when frequent or habitual, are punishable offenses.
