The Antecedents: On January 5, 1996, at around 2:30 AM in Brgy. Collado, Talavera, Nueva Ecija, Alberto Alejandro y Rigor (Alejandro) and Joel Angeles y de Jesus (Angeles), along with two John Does, allegedly attacked and killed BBB. Subsequently, Alejandro and Angeles allegedly took turns in having carnal knowledge of AAA, with Angeles restraining AAA's arms while Alejandro committed the rape, and then they switched roles. AAA identified Alejandro and Angeles from mugshots shown by police officers at the hospital where she was taken after losing consciousness. Medical records confirmed AAA was sexually assaulted and BBB died of "neurogenic shock" secondary to "multiple blunt injury and fracture of the mandibular and facio-maxillary bones." Procedural History: Three separate Informations were filed charging Alejandro and Angeles with Simple Rape and Homicide. The RTC convicted both accused-appellants of Simple Rape and Homicide. The CA affirmed the RTC ruling with modifications, finding Alejandro guilty of Simple Rape in one case, Alejandro and Angeles guilty of Simple Rape in another case, and both guilty of Homicide. The CA also found Angeles guilty of two counts of Simple Rape in one case. Accused-appellants appealed to the Supreme Court. The Petition: Accused-appellants Alberto Alejandro y Rigor and Joel Angeles y de Jesus appealed their conviction for Simple Rape and Homicide.

Ratio Decidendi
On the guilt of Joel Angeles y de Jesus for Qualified Rape and Homicide, and the modification of conviction from Simple Rape to Qualified Rape: The Court upheld the findings of fact of the RTC and CA, giving credence to AAA's positive identification of Angeles as one of the perpetrators. The elements of homicide were proven, namely, that a person was killed, that Angeles killed her without justification, with intent to kill (presumed), and without qualifying circumstances of murder. Regarding rape, the Court found that Angeles had carnal knowledge of AAA through force and intimidation, as he restrained her arms while Alejandro raped her, and then he took his turn. The Court also found conspiracy between Alejandro and Angeles in the commission of the crimes, evidenced by their cooperative actions in stabbing BBB and their coordinated actions during the rape of AAA. The Court found that the CA erred in convicting Angeles for two counts of Simple Rape in Crim. Case No. 73-SD(96), as the amended Information charged only one count of Rape. Therefore, Angeles should only be convicted of one count of Rape, upgraded to Qualified Rape due to the conspiracy and the commission of the act by two persons, as per Article 335 of the Revised Penal Code. On the penalties and damages: For Qualified Rape in Crim. Case No. 73-SD(96), Angeles was sentenced to suffer the penalty of reclusion perpetua and ordered to pay AAA ₱75,000.00 as civil indemnity, ₱75,000.00 as moral damages, and ₱75,000.00 as exemplary damages. For Homicide in Crim. Case No. 74-SD(96), Angeles was sentenced to imprisonment for an indeterminate period of six (6) years and one (1) day of prision mayor, as minimum, to fourteen (14) years, eight (8) months, and one (1) day of reclusion temporal, as maximum, and ordered to pay BBB's heirs ₱50,000.00 as civil indemnity, ₱50,000.00 as moral damages, and ₱50,000.00 as temperate damages. All monetary awards are subject to legal interest at the rate of six percent (6%) per annum from the finality of judgment until fully paid.
