Facts

The Antecedents: On July 26, 2007, AAA was invited to a drinking spree. After consuming rum, she felt dizzy. Jonathan Pal, Thaniel Magbanta, Tatan Cutacte, and appellant Ron Aries Dagatan Cariat alias Dodong Mango dragged her to a secluded area. Appellant pointed a knife at AAA and held her legs while Magbanta punched her, warned her not to shout, undressed her, and forcibly had carnal knowledge of her. Pal and Cutacte acted as lookouts, and all the accused laughed during the commission of the crime. AAA lost consciousness and woke up later, finding herself wearing only her bra and panty. She did not report the incident for three months due to trauma. Procedural History: The Information charged appellant and three co-accused with rape. Only appellant was arrested. The RTC of Davao City, Branch 11, found appellant guilty beyond reasonable doubt of rape, sentencing him to reclusion perpetua and ordering him to pay moral damages. The RTC found that conspiracy was established and that appellant's participation in holding AAA's legs constituted direct participation. The Court of Appeals (CA) affirmed the RTC's decision with modification, increasing the damages and ordering interest. The CA found that the elements of rape were sufficiently established and that conspiracy existed. The Petition: Appellant appealed to the Supreme Court, arguing that the prosecution failed to prove his guilt beyond reasonable doubt, specifically the sexual and physical assault, and the existence of conspiracy.

The testimony of AAA detailed that Magbanta had sexual intercourse with her with the assistance of appellant and the other co-accused. AAA testified that appellant held her, pointed a knife at her, and helped drag her to a secluded area. Appellant then held her legs while Magbanta committed the rape. These circumstances demonstrated that Magbanta had sexual intercourse with AAA against her will through force, threat, and intimidation, with the assistance of appellant and the other accused. The Court found no reason to reverse the RTC's assessment of AAA's credibility, which was affirmed by the CA, stating that the trial court's assessment of witness credibility is entitled to great weight. The Court reiterated that the fact of sexual and physical assault was sufficiently established through AAA's testimony. On the issue of conspiracy: The Court found that conspiracy was established. Conspiracy exists when the acts of the accused demonstrate a common design towards the accomplishment of the same unlawful purpose. While appellant did not personally have sexual intercourse with AAA, his acts of helping to restrain AAA, dragging her to a secluded area, pointing a knife at her, and holding her legs while Magbanta raped her clearly demonstrated a common design to rape AAA. The Court concluded that appellant concurred in the criminal design to rape AAA. Since conspiracy was established, the act of one conspirator was deemed the act of all, making them equally guilty of the crime of rape. On the award of damages: The Court modified the award of damages based on the ruling in People v. Jugueta. The Court held that when the circumstances call for the imposition of reclusion perpetua without ordinary aggravating circumstances, the proper amounts for civil indemnity, moral damages, and exemplary damages should be ₱75,000.00 each. Therefore, the Court increased the civil indemnity and moral damages to ₱75,000.00 each and imposed exemplary damages of ₱75,000.00. All awarded damages were ordered to earn interest at the rate of 6% per annum from the finality of the decision until fully paid.

Main Doctrine

Conspiracy to commit rape is established when the acts of the accused demonstrate a common design towards the accomplishment of the unlawful purpose, making the act of one conspirator the act of all. The testimony of the victim, when found credible by the trial court and affirmed by the appellate court, is sufficient to establish the elements of rape, including the use of force, threat, or intimidation, and the participation of co-conspirators.
