Facts

The Antecedents: Accused-appellant Arnaldo Enriquez, Jr. (Enriquez) was charged with Murder for allegedly stabbing Florencio Dela Cruz y Dela Cruz on December 30, 2006, in Quezon City. The prosecution presented evidence that Luisa and Jessica Tolentino heard moaning, saw Dela Cruz coming out of his house bloodied, and then witnessed Enriquez stab him with a bread knife. Dela Cruz was pronounced dead on arrival at the hospital due to multiple stab wounds. Barangay Security Development Officer Obar arrested Enriquez and recovered a knife. The defense claimed Enriquez was on duty as a security guard at the time of the incident. Procedural History: The Regional Trial Court (RTC), Branch 105, Quezon City, convicted Enriquez of Murder and sentenced him to reclusion perpetua, with civil indemnity and moral damages. The Court of Appeals (CA) affirmed the conviction with modifications to the damages awarded. The Petition: Enriquez appealed to the Supreme Court, questioning his conviction for Murder.

Ratio Decidendi

On the issue of whether the Court of Appeals erred in affirming Enriquez's conviction for Murder, specifically regarding the presence of treachery: The Court found that while the RTC and CA convicted Enriquez of Murder, the qualifying circumstance of treachery was not sufficiently proven. The prosecution witnesses did not witness the commencement of the attack. The Court reiterated that treachery must be proven by clear and convincing evidence, including the manner in which the aggression was made and how it began and developed. Since the events inside the house were unknown to the witnesses, the element of treachery was not established. For treachery to be appreciated, it must be shown that the offender employed means, methods, or forms in the execution of the criminal act which gave the person attacked no opportunity to defend himself or to retaliate, and that these means were deliberately adopted by the assailant. The prosecution failed to prove these elements because the witnesses did not see how the attack started. The fact that the victim was stabbed from behind as he was coming out of his house, already bloodied, does not automatically establish treachery. Treachery cannot be appreciated from suppositions drawn only from circumstances prior to the very moment of aggression, nor can it be considered where the lone witness did not see the commencement of the assault. Therefore, the conviction for Murder was improper. On the issue of the proper penalty and award of damages, considering the absence of treachery: With the removal of the qualifying circumstance of treachery, the crime was downgraded from Murder to Homicide. The penalty for Homicide under Article 249 of the Revised Penal Code is reclusion temporal. In the absence of modifying circumstances, the penalty is imposed in its medium period. Applying the Indeterminate Sentence Law, the penalty next lower in degree is prision mayor. Thus, Enriquez was sentenced to suffer the indeterminate penalty of eight (8) years and one (1) day of prision mayor, as minimum, to fourteen (14) years, eight (8) months, and one (1) day of reclusion temporal, as maximum. Following the ruling in People v. Jugueta, the damages were modified to civil indemnity, moral damages, and temperate damages of ₱50,000.00 each, with legal interest.

Main Doctrine

The qualifying circumstance of treachery must be proven by clear and convincing evidence, including the manner in which the attack commenced and developed. If the prosecution witnesses only observed the events after the initial assault, treachery cannot be appreciated.
